HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 08-00970 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S EMERGENCY FINDINGS, WAIVING SEALED COMPETITIVE BIDDING PROCEDURES, PURSUANT TO SECTION 18-90 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; AUTHORIZING THE PROCUREMENT OF STRUCTURAL REMEDIATION SERVICES FOR THE PROJECT ENTITLED "CITY HALL RESTORATION PROJECT, B-30121," FROM WALTER L. LISTA, INC., IN AN AMOUNT NOT TO EXCEED $298,00, FOR THE SCOPE OF WORK, PLUS AN ADDITIONAL $120,000, OWNER CONTINGENCY, FOR A TOTAL NOT TO EXCEED CONTRACT AMOUNT OF $418,000; ALLOCATING FUNDS FROM CAPITAL IMPROVEMENT PROJECT NO. B-30121; AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, FOR SAID PURPOSE. WHEREAS, the Capital Improvements Department ("the Department") initiated a structural analysis of the City Hall Basement on December 6, 2007, via a work order to Astorino, Inc., with analysis performed by their structural sub -consultant, Bliss and Nyitray, Inc.; and WHEREAS, the interior steel columns were uncovered, revealing extensive damage on the structural steel columns that present a life safety issue; and WHEREAS, the analysis indicated that immediate action should be undertaken to repair the structural columns, removing old steel and encasing columns in concrete; and WHEREAS, in order to expedite an award and ensure that the City of Miami ("City") obtained a qualified contractor and a fair and reasonable price, the Department, in conjunction with the City Manager's office, utilized a competitive process where five (5) companies specializing in this type of work were invited to submit sealed bids in a reduced bidding timeframe of thirteen (13) days; and WHEREAS, the Department determined Walter L. Lista, Inc. to be the lowest responsive and responsible bidder, at a bid price of $298,000, for the scope of work; and WHEREAS, it has been determined that the owner needs to carry contingency to cover unforeseen work, such as relocating electrical and plumbing utilities or conduits, in an amount not -to -exceed $120,000; and WHEREAS, the City Manager approved the Department's finding and determined that it was in the best interest of the City to use an expedited procurement method, and that in this instance competitive sealed bidding procedures of Section 18-85 of the Code of the City of Miami, Florida, as amended ("City Code) were not practicable or advantageous to the City; and City of Miami Page 1 of 3 Printed On: 8/25/2008 File Number. 08-00970 WHEREAS, pursuant to a motion approved by the City Commission July 24, 2008, based on the City Manager's recommendation, dated July 22, 2008 and attached hereto, authorization for Walter L. Lista, Inc. to commence work was given upon the condition that retroactive City Commission approval of the award and waiver of competitive bidding procedures would be sought in September, according to Section 18-90 of the City Code; and WHEREAS, the City Manager thus formally requests authorization to hire Walter L. Lista, Inc., to provide this work, and to execute an agreement, in substantially the attached form, for said purpose; and WHEREAS, funds for the Project are available under Capital Improvement Project ("CIP") "City Hall Restoration Project, B-30121," in the not to exceed amount of $418,000; and WHEREAS, the findings of the City Manager have been duly considered and adopted by the City Commission; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's emergency findings, waiving sealed competitive bidding procedures, pursuant to Section 18 -90 of the City Code, are ratified, approved and confirmed, and the procurement of structural remediation services for the project entitled "City Hall Restoration Project, B-30121," from Walter L. Lista, Inc., is authorized, in an amount not to exceed $298,00, for the scope of work, plus an additional $120,000, owner contingency, for a total not to exceed contract amount of $418,000, with funds allocated from CIP No. B-30121. Section 3. The City Manager is attached form, for said purpose. Section 3.
