A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S
EXECUTION OF MODIFICATION #1 TO THE GRANT AGREEMENT, IN
SUBSTANTIALLY THE ATTACHED FORM, WITH THE FLORIDA DEPARTMENT
OF COMMUNITY AFFAIRS AND MIAMI-DADE COUNTY IN ORDER TO EXTEND
THE PRE -DISASTER GRANT AGREEMENT #07-DM-68-11-23-02-452 PROJECT
#PDMCS - 022, FROM SEPTEMBER 8, 2008 TO FEBRUARY 27, 2009,
PURSUANT TO RESOLUTION NO. 07-0074, ADOPTED FEBRUARY 8, 2007;
FURTHER AUTHORIZING THE CITY MANAGER TO EXTEND SAID GRANT
AWARD AND TO EXECUTE ANY OTHER RELATED AMENDMENTS OR
EXTENSIONS ON ALL MATTERS EXCEPT THOSE DEALING WITH FUNDING
CHANGES.
WHEREAS, the City of Miami has been awarded a grant by the Department of Community Affairs;
and
WHEREAS, pursuant to grant stipulations, said funds will be used to improve the drainage area
referred to as "The N.E. 71 st Street Storm Sewer Project"; and
WHEREAS, the Grant Agreement ("Agreement") expires on September 8, 2008; and
WHEREAS, The Department of Community Affairs desires to reinstate the Agreement and to
modify the Agreement by extending it to February 27, 2009; and
WHEREAS, the parties desire to extend the Agreement to February 27, 2009 in order to complete
the Scope of Work, as set forth in the Attachment A; and
WHEREAS, the City Manager executed the attached modification, subject to City Commission
ratification, to reinstate the Agreement;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager's execution of Modification #1 to the Pre -Disaster Grant Agreement,
in substantially the attached form, extending the Agreement from September 8, 2008 to February 27,

2009, pursuant to Resolution No. 07-0074 adopted February 8, 2007, is ratified, approved and
confirmed.
Section 3. The City Manager is further authorized {1} to extend said grant award and to execute
any other related amendments or extensions on all matters except those dealing with funding
changes.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including, but not limited to, those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
