HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 08-00952 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), RESCINDING RESOLUTION NO. 07-0554, ADOPTED SEPTEMBER 27, 2007, THAT AUTHORIZED THE CITY MANAGER TO EXECUTE A PERMIT AGREEMENT WITH MIAMI-DADE COUNTY; AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE AGREEMENT (THE "AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN MIAMI-DADE COUNTY ("COUNTY") AND THE CITY OF MIAMI FOR OCCUPANCY OF 1701 NORTHWEST 30 AVENUE, MIAMI, FLORIDA, FOR A TERM OF ONE (1) YEAR, WITH FOUR (4) OPTIONS TO EXTEND FOR ONE (1) YEAR EACH, COMMENCING ON THE EARLIER OF THE EFFECTIVE DATE OF THE RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OR JANUARY 1, 2008, FOR A TOTAL RENTAL FEE OF ONE DOLLAR, WITH TERMS AND CONDITIONS AS MORE PARTICULARLY SET FORTH IN THE AGREEMENT. WHEREAS, Miami -Dade County ("County") owns certain property located at 1701 Northwest 30 Avenue, Miami, Florida ("Property"), that was once occupied by the Department of Human Services; and WHEREAS, on September 27, 2007, the City Commission approved Resolution No. 07-0554, which authorized the City Manager to execute a Permit Agreement for the City of Miami's ("City's") Police Department to use the Property for a period of one year with an additional one-year option; and WHEREAS, the County subsequently increased from one to four, the number of one-year options the City could exercise and determined that a Lease Agreement ("Agreement") better suited the new, longer terms than a Permit Agreement; and WHEREAS, the. Agreement still provides for the City's use of the Property for a total rental fee of One Dollar; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Resolution No. 07-0554, adopted September 27, 2007, which authorized the City Manager to execute a Permit Agreement with the County is rescinded. Section 3. The City Manager is authorized{1 } to execute an Agreement, in substantially the City of Miami Page 1 of 2 Printed On: 8/22/2008 File Number. 08-00952 attached form, between the County and the City for the occupancy of the Property for a term of one (1) year, with four (4) options to extend for one (1) year each, commencing on the earlier of, the effective date of the Resolution of the Board of County Commissioners or January 1, 2008, for a total rental fee of One Dollar for each year, with terms and conditions as more particularly set forth in the Agreement. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS: JULIE CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
