Subject: Resolution authorizing the City Manager to execute Amendment #3 of the Agreement between
the City of Miami and Florida Land and Water Conservation Fund (LWCF No. 12-00461).
Purpose of Item:
The administration recommends that the Miami City Commission adopt the attached Resolution
authorizing the City Manager to execute Amendment #3 ("Amendment"), in substantially the attached
form to the LWCF 12-00461 Grant Agreement ("Agreement"), between the City of Miami ("City")
and the Florida Land and Water Conservation Fund ("FLWC"), to modify the list of project elements
and close out the Agreement, as more particularly described in Exhibit "A" attached hereto and made
a part hereof

Subject: Resolution authorizing the City Manager to execute Ainendment #3 of the Agreement between
the City of Miami and Florida Land and Water Conservation Fund (LWCF No. 12-00461).
Background Information:
The City and the Miami Parking Authority ("Authority"), entered into an Agreement ("Agreement")
on August 8, 2002 to design, construct, finance, operate, maintain and manage the Boat Ramp Parking
Facility in the City of Miami at Watson Island. While the City leveraged substantial funding from
other grant sources for coastal stabilization features along the southern shoreline, the City needed
additional monies to curb soil erosion, provide shoreline protection as well as provide public seating
facilities along the baywalk area earmarked for this southern shoreline. Currently approximately 500
linear feet along the southeastern shoreline of Watson Island has no shoreline protective feature for
this surface soil.
The City received a grant from the Florida Land and Water Conservation Fund ("FLWC") in the
amount of $200,000, with a required local match of an equal amount being funded by the City and the
Authority, to aid in funding the construction of the restroom facilities and the baywalk at Watson
Island. The restroom facilities were completed in 2005.
The City received two extensions from the grantor extending the term for construction completion of
the baywalk to August 11, 2008 due to timing and change in design criteria that delayed the
anticipated construction and financial schedules. The City's consultant met with DERM and revised
the project's designs to meet DERM's requirements prior to submitting a formal application. The
new cost to complete the baywalk work based on DERM's requirements was in excess of $735,000.
Due to the fact the City did not have the additional funds to complete the project as modified by
DERM, the City requested and received approval from the grantor to modify the list of original
project elements to comply with grant requirements and subsequently close-out the grant. All monies
spent on the completion of the various project elements within the grant's scope of work were
requested and have been reimbursed to the City; therefore, this item has no budgetary impact on the
City.
