AN ORDINANCE OF THE CITY OF MIAMI COMMISSION
AMENDING ORDINANCE NO. 12280, AS AMENDED,
THE CAPITAL IMPROVEMENTS APPROPRIATIONS
ORDINANCE, TO INCREASE APPROPRIATIONS IN THE
AMOUNT OF $200,000, IN CAPITAL IMPROVEMENT
PROGRAM PROJECT NO. 333126, ENTITLED "WATSON
ISLAND IMPROVEMENTS," SAID FUNDS RECEIVED AS
A GRANT FROM THE FLORIDA LAND AND WATER
CONSERVATION FUND FROM THE STATE OF FLORIDA
DEPARTMENT ON ENVIRONMENTAL PROTECTION FOR
THE DESIGN AND CONSTRUCTION OF A BAYWALK ON
WATSON ISLAND; AUTHORIZING THE CITY MANAGER
TO ACCEPT THE GRANT AND TO EXECUTE THE
NECESSARY DOCUMENT(S), IN A FORM ACCEPTABLE
TO THE CITY ATTORNEY, TO IMPLEMENT
ACCEPTANCE OF SAID GRANT.
WHEREAS, on March 11, 2002, the City of Miami submitted a
proposal to the Florida Department of Environmental Protection
for funding, in the amount of $200,000, from the Land and Water
Conservation Fund to design and construct a Baywalk on Watson
Island; and
WHEREAS, the City of Miami was awarded the full amount
requested; and

WHEREAS, the grant funds received from the Florida Land and
Water Conservation Fund need to be appropriated into Capital
Improvement Project No. 333126, entitled "Watson Island
Improvements;"
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble —ro this Ordinance are adopted --by reference and
incorporated as if fully set forth in this Section.
Section 2. Ordinance No. 12280, as amended, is further
amended in the following particulars:!'
"Ordinance No. 12280
Section 1. The herein appropriations are hereby made for
implementation of all municipal capital improvements of the City
of Miami, including new capital improvement projects scheduled to
begin during Fiscal Year 2003. The herein appropriations which
are hereby designated by reference to descriptive project title
and number also include appropriations for previously approved
scheduled projects as well as reappropriations of prior funds.
The sources of revenues to support the herein appropriations are
hereby identified by fund and project as follows:

provisions are now in effect and remain unchanged. Asterisks
indicate omitted and unchanged material.

Section 3. The City Manager is authorized?! to accept a
Land and Water Conservation Fund Grant in the amount of
$200,000, from the Florida Department of Environmental
Protection, for the design and construction of a Baywalk on
Watson Island and execute the necessary documents, in a form
acceptable to the City Attorney, to implement acceptance of said
Grant.
Section 4. All ordinances or parts of ordinances,
insofar as they are in conflict with provisions of this
Ordinance are repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid,
The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including
but not limited to those prescribed by applicable City Charter and
Code provisions.

the remaining provisions of this Ordinance shall not be
affected.
Section 6. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.-'

This Ordinance shall become effective as specified herein unless
vetoed by the Mayor within ten days from the date it was passed
snd adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City
Commission or upon the effective date stated herein, whichever is
later.
