Miami -Dade County School Board - Facilities Planning Section 1450 NE 2t'd Avenue Miami, FL 33132 Re: Grove Village/ Land Use Change/ April 16, 2008 PAB Agenda/ Item #4 Dear Ms. Vi1(amil: On behalf of GV Birxaini, LLC and GV Freeport, LLC, and pursuant to our conversation today regarding the Grove Village Project located between Florida and Thomas Avenues on the North and South and Plaza and Hibiscus Streets on the West and East respectively in Coconut Grove (the "Project"), please accept this letter as confirmation of our decision as to how to satisfy the requirements of the Miami -Dade County School Board's Interlocal Agreement. As you are aware, we are seeking a land use change on the several parcels at the aforementioned location. A portion of the requested land use change involves a change from the "Single Family Residential" designation to the "Restricted Commercial" designation and also from "Duplex Residential" to "Restricted Commercial". Therefore, the Project proposes NOT to increase density beyond the density currently permitted on these respective parcels. In other words, the portions of the Project which are changing from "Single Family" and "Duplex" to "Restricted Commercial" are planned to be developed with not more than the allotted nine (9) dwelling units per acre for Single Family Residential and not more than the eighteen (18) units per dwelling acre for the "Duplex Residential" currently permitted on those respective parcels within the Project. As such, there will be no need for mitigation under the School Board Interlocal Agreement since there will be no residential density increase as a result of the development of the Project. Stinson Pursuant to the state -mandated and School Board approved Interlace! Agreement, local government, the development community and the School Board are to collaborate on the options to address the impact of proposed residential development on public schools where the proposed development would result in an increase in the schools' FISH % utilization (permanent and relocatable), in excess of 115%. Attached please find the School District's (District) updated review analysis of potential impact generated by the above referenced application. This application is part of the larger Project, referred to as Grove Village (Project), which will be considered by the Large Scale Development Committee on May 7, 2008. Please note that the original review indicated that one of the impacted school facilities met the referenced review threshold: Coral Gables Senior High school currently operating at 125% of FISH capacity utilization. However, the applicant has advised the District that there would not be any additional residential units beyond what the current land permits. Additionally, at its April 13, 2005 meeting, the Board approved School District criteria that would allow District staff to make recommendations on residential zoning applications that impact public schools beyond the 115% of FISH capacity threshold (Review Criteria). Under these guidelines, the District met with the applicant on April 16, 2008, to discuss the impact of the proposed development on public schools. At said meeting the applicant agreed to proffer a letter (copy attached) committing to restrict the residential density of the Project to no more than the allotted nine (9) dwelling units per acre for "Single Family Residential" designation and not more than the eighteen (18) units per dwelling acre for the "Duplex Residential" designation, currently permitted on those respective parcels within the Project. In this regard, a Declaration of Restrictions will be proffered to the City Commission at the appropriate time. As such, for the land use phase of the Project, there is no need to mitigate over and above the requisite Educational Facilities Impact Fees (Impact Fees). Pursuant to Impact Fee Ordinance the proposed development, if approved, will be required to pay Impact Fees based on the following formula: New residential unit square footage X .90 (Square Footage Fee) + $600.00 (Base Fee) + 2% administrative fee = Educational Facilities Impact fee As an example, assuming the proposed unit is 1,000 square feet, the 276-unit development is estimated to generate approximately $414,000 ($1,500 per unit, excluding the 2% administration fee) in impact fees. This figure may vary since the impact fees assessed are based on the actual square footage of each dwelling unit. Thank you in advance for your cooperation in this matter.
