The memo, which is attached, advised in detail that the final version of the ordinance regarding distance between locations selling alcohol in the Wynwood district was transcribed incorrectly. The memo further advised that your office and Municode Corporation should adjust the records accordingly, the adjustment being a scriveners' amendment. In your subsequent email to the City Attorney, you asked how the amendment should be made. You also asked me about the legality and logistics of actually making the corrections and whether you, as the City Clerk, had the legal authority to correct legislation that had been enacted and codified. It is the legal opinion of the office of the City Attorney that the City Charter of the City of Miami, in Section 49, provides you with the legal authority to maintain and to correct, when necessary, the City records. This changedoes not require City Commission action since it is a scrivener's amendment. Attached is the amendment. Please adjust the Legistar records and submit the changes to Municode Corporation because the evidence (the minutes of the meeting) indicate that the ordinance was transcribed inaccurately.
