HomeMy WebLinkAboutLegislationCity of Miami Legislation Ordinance City Hail 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 08-00800 Final Action Date: (4/5THS) AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 54/ARTICLE IV OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "STREETS AND SIDEWALKS/NAMING OF STREETS AND NUMBERING OF BUILDINGS," MORE PARTICULARLY BY AMENDING SECTION 54-137 OF SAID CODE, "STREET CODESIGNATION," TO ALLOW STREETS TO BE CODESIGNATED WITH THE NAMES OF LIVING INDIVIDUALS PURSUANT TO A FOUR -FIFTHS AFFIRMATIVE VOTE OF THE MIAMI CITY COMMISSION, WHEN DESIGNATION IS REQUESTED FOR A GROUP, AND AT LEAST HALF THE MEMBERS OF THE GROUP ARE DECEASED; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Code of the City of Miami, Florida, as amended ("City Code"), does not currently permit streets to be codesignated with the names of living individuals; and WHEREAS, the City Commission would like to grant codesignations, in unique circumstances, to living individuals who have provided significant historical, neighborhood or community benefits; and WHEREAS, the City Commission, after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City and its inhabitants to amend the City Code, to allow streets to be codesignated with the names of living individuals, pursuant to a four -fifths affirmative vote of the City Commission, when designation is requested for a group, and at least half the members of the group are deceased; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Chapter 54/Article IV/Section 54-137 of the City Code, entitled "Streets and Sidewalks/Naming of Streets and Numbering of Buildings/Street Codesignation," is amended in the following particulars:{1 } "CHAPTER 54 STREETS AND SIDEWALKS ARTICLE IV. NAMING OF STREETS AND NUMBERING OF BUILDINGS * * * * * City of Miami Page 1 of 3 Printed On: 7/14/2008 File Number: 08-00800 Sec. 54-137. Street codesignation. The city commission shall consider proposals for street codesignation using the following criteria: (1) Named streets, e.g., as in Coconut Grove, shall not be changed where there is an historical tradition attached to the existing name. (2) Named streets shall not be codesignated because of the resulting confusion. (3) Numbered streets shall not be codesignated for merely commercial purposes. (4) Numbered streets shall only be codesignated if there is significant historical, neighborhood or community benefit to the codesignation. (5) Numbered street codesignations shall not exceed five blocks in length. (6) There shall be a hiatus at least five blocks in length between consecutive codesignations in numbered streets. (7) Numbered streets shall not be codesignated with the names of living individuals. This provision can be waived by a four -fifths affirmative vote of the Miami City Commission, when designation is requested for a group, and at least half the members of the group are deceased, (8) Block numbers shall be added to any new street signs that reflect codesignations, markers or plazas. *II Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance is declared to be an emergency measure on the grounds of urgent and public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 5. The requirements of reading this Ordinance on two separate days is dispensed with an affirmative vote of not less than four -fifths (4/5ths) of the -members of the Commission. Section 6. This Ordinance shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS: City of Miami Page 2 of 3 Printed On: 7/14/2008 File Number: 08-00800 Footnotes: {1} Words and/or figured stricken through shall be deleted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
