BEFORE THE CITY COMMISSION 20118 W 19 Ph 3: 5 °` OF THE CITY OF MIAMI 1000 BRICKELL AVENUE Condominium Association, Inc. and Otis Wragg Appellants, vs. Alphatur, N.V. and CITY OF MIAMI Appellees ZONING BOARD CASE NO. 08-00169v W ice I = o i--- [J- q) ®cn �n Z o ®moo _W co co C,0 a_ 1--- MOTION TO DISMISS NOTICE OF APPEAL Appellee, 888 Brickell Avenue, Miami, Florida, moves to dismiss the Notice of Appeal filed by Appellants, 1000 Brickell Avenue Condominium Association, Inc. and Otis Wragg, 1000 Brickell Avenue, Unit 400, Miami, Florida 33131, regarding the variances granted by the City of Miami Zoning Board ("Board") on March 24, 2008 (Case No: 08-00169). FACTS Appellee is the owner of property located at 888 Brickell Avenue, Miami, Florida ("Property"). Appellee filed a request for four variances regarding the Property ("Application"). Thompson City Clerk appeared at the hearing to oppose the Application, nor did anyone submit any comment cards opposing the Application. On April 7, 2008, Appellants purported to file an appeal with the Department of Hearing Boards, challenging the Zoning Board's action regarding the Application. Neither 1000 Brickell Avenue Condominium Association, Inc. nor Otis Wragg appeared at the Zoning Board meeting, nor did either of them submit anything into the record objecting to the Application. ARGUMENT Appellants' appeal should be dismissed for the following reasons: Appellants Lack Standing Because they Failed to Exhaust Their Administrative Remedies Appellants have no standing to appeal the Board's Order, as they failed to exhaust their administrative remedies. First, the instant matter is an appeal of an otherwise final order made by the Zoning Board See Article 20, section 2002, of the City of Miami Zoning Code ("Zoning Code")("A request for review of a zoning board decision by the city commission shall be filed with an officer or agent designated by the city manager stating the specific reasons for such appeal, together with payment of any required fee"). As an appeal, Appellants are required to exhaust administrative remedies. Further, pursuant Article 20, section 2005 of the City of Miami Zoning Code ("Zoning Code") requires that "no application shall be made to the court for relief from decisions made pursuant to the zoning ordinance unless the aggrieved party has first exhausted all remedies provided under the zoning ordinance." (Emphasis added). While Appellants seek relief to the City Commission from the Zoning Board's decision, the intent of the Code is apparent: administrative remedies must be exhausted in order to challenge decisions made pursuant to the Zoning Code. Thompson City Clerk decision of the City Commission to court in this matter, since Appellants failed to appear at the Zoning Board meeting. It is therefore illogical to allow the Appellants to challenge the Zoning Board's decision to the City Commission when Appellants would be unable to seek relief in court from the City Commission's decision. The essential administrative remedy available to Appellants was an opportunity to appear before the Board and oppose Appellee's application for a variance. The variance application process requires that notice of the application be published as well as mailed to property owners within 500 feet of the subject application. Nevertheless, in spite of the proper notice procedures being followed, Appellants chose not to attend the hearing and voice their objections. Instead, they waited for the Board to hear and consider arguments related to the variance and, only after being unsatisfied with the decision, decided to challenge the variance. Pursuant to the Zoning Code, Appellants' failure to attend the hearing and exhaust their administrative remedy prevents Appellants from filing the subject appeal. City Commission May Not Make Determination on Issue Where Zoning Board Was Not Given Similar Opportunity The very purpose of a hearing before the Board is to provide individuals with opportunities to set forth arguments for the Board to consider in reaching its decision, and to ensure that the Board is afforded the benefit of considering all issues relating to the application before it. See, e.g., Gen. Electric Credit Corp. of Georgia v. Metropolitan Dade County, 346 So. 2d 1049, 1053 (Fla. 3d DCA 1977) (upholding dismissal of a petition for failure to exhaust administrative remedies and, in considering a revised proposal which was not before the Board, stating, "we will not take it upon ourselves to make such a determination where the proper administrative agencies have been denied a similar opportunity"). Thompson City Clerk before the Zoning Board and failed to provide the Zoning Board with the opportunity to consider Appellants' objections. Appellants cannot, therefore, appear for the first time on this matter on an appeal to the City Commission.' See, e.g., Ft. Lauderdale Bd_ of Adjustment v. Nash, 425 So. 2d 578, 579 (Fla. 4th DCA 1982) (holding that the Circuit Court acted inappropriately by reversing the Board of Adjustment's denial of a variance, since petitioner espoused a new argument which was not properly placed in issue before the Board); see also Battaglia Fruit Co. v_ City of Maitland, 530 So. 2d 940, 943 (Fla. 5th DCA 1988) (dismissing a petition for writ of certiorari because the proper administrative agency was not given opportunity to correct its decision where petitioner failed to provide information to the reviewing body for consideration). Here, Appellants failed to exhaust their administrative remedies and, therefore, should be barred from presenting arguments which they failed to present before the Board. More specifically, Appellants should have been present at the hearing before the Board to present their opposition to the variance. The hearing is an administrative remedy that was available to them, which they failed to attend. They cannot now espouse new arguments for the first time on appeal. Accordingly, Appellants' appeal should be dismissed for failure to exhaust their administrative remedies. Appellee reserves its right to supplement its arguments prior to or at the City Commission's consideration of this issue. Although the hearing before the City Commission must be conducted de novo, this applies only to evidence and does not 1vaive the requirement that Appellants' appear before the Zoning Board to have standing. Additionally, the City now requires that parking structures be dad with habitable space. Toward this end, the City Commission has recently approved a number of new residential units in the ,City's Central Business District, along the Miami River, in the Brickell, ,Brickell , lest and Omni -Edgewater areas of the City. Approval of the proposed project, is .generally consistent with the above -stated objectives; however, in this instance, the target market for the proposed units will be corporations doing business in Downtown Miami rather than individuals. These expenditures will have an overall economic impact on the City of $6.3 million annually when the multiplier effect is considered. • A total of 575 people wilt be employed at the proposed project. These workers, who may include City residents, will earn approximately $28.75 million annually. Bases of Estimates The materials that follow provide the assumptions used to estimate the fiscal and economic benefits that development of the proposed mixed -use project at 888 Brickell Avenue will provide to the City of Miami. All monetary values are stated in 2008 Constant Dollars. Project Characteristics • The proposed mixed -use will be located within the City of Miami and as well as the jurisdictions of the City's Downtown Development Authority, Miami -Dade County and the Miami -Dade County Public School District. • The project will entail the construction of 437,739 gross square feet of building area. Of this amount, 28,486 square feet will pertain to the salable residential portion of the project, which will be comprised of the 29 condominium units. The remaining 409,253 square feet will be comprised of the office and retail space as well as parking. Of this amount, 136,731 square feet will represent rentable office space and 3,018 square feet will representrentable. retail space. • The proposed mixed -use project will replace an existing office building with approximately 30,000 square feet of leasable space, In calculating impact fees, a credit in that amount will be need to be taken into consideration, with the result that impact fees for office space will be calculated based on 106,731 square feet. • The proposed mixed -use project will cost approximately $42.0 million to construct in terms of hard construction. According to the Constitution of the State of Florida, real property is supposed to be assessed at 100 percent of its market value. As a practical matter. condominium unit are initially placed on the tax rolls at approximately 80 percent of their market value, or in this case $9.2 million Assuming that the proposed units are absorbed by corporate entities, they will not qualify for the homestead exemption, Accordingly, the taxable value of the residential portion of project wilt also be $9.2 million. • Based a review of assessment values for comparable retail and office projects, it is estimated that the 139,749 square feet of combined office and retail space will have an assessed and taxable value approximating $45.0 million. • The total estimated taxable value of the proposed mixed -use project at 888 Brickell Avenue will be $54,2 million. • For the purpose of this analysis, it is estimated that the people occupying the proposed condominium units will spend $1.0 million annually in retail and food and beverage establishments, a figure that recognizes that the units will not be occupied on a full-time basis. • Based on industry averages relating to employment per 1,000 square feet, it is estimated that 550 people will be employed in the office and retail space in proposed mixed -use project_ When projects operations maintenance and service personnel are accounted for, total employment at the project will approximate 575 people Based on information compiled by the State of Florida's Agency for Workforce Innovation, it is estimated that these workers will earn an average annual salary approximating $50,000, or $28.75 million in total. They workers are expected to spend a total of approximately $2.5 annually in restaurants and shops while working. Non -recurring Fiscal Impacts • The City of Miami charges building permit fees at a rate of $0.20 per gross square foot of multi -family residential construction and $0.25 per gross square foot of commercial construction. In calculating fees, the square footage associated with parking garage space is charged for at the commercial rate. Based on the distribution of space by use previously discussed, building permit fees totaling $108,010 will be paid for the proposed mixed -use project at 888 Brickell Avenue. Calculation of the fees that they will pay requires that the project's final engineering drawings be completed, which has not yet occurred. Accordingly, the fees that will be paid can not be quantified at this time. A solid waste surcharge is applied to these fees. • The City of Miami charges impact fees on new construction projects. On high-rise units, fees for condominium units will be paid on a per unit basis in the amounts of $95 for police, $409 for fire -rescue. $239 for general services and $3.959 for parks. The rates for office space in the quantity proposed are paid on a per square foot basis in the amounts of $0 176 for police. $0.317 for fire -rescue and $0.132 for general services. The rates for retail space in the quantity proposed are paid on a per square foot basis in the amounts of $0.751 for police, $0.302 for fire -rescue and $0.126 for general services Impact fees totaling $206,623 will be paid on the proposed mixed -use project, of which $23,806 will be for police. $46,606 for fire - rescue. $21.400 for general services and $114,811 for parks • In addition to the impact fees discussed in the preceding paragraph that are charged to projects anywhere within the City of Miami, supplemental impact fees are charged on projects located in the area covered by the Downtown DRI According to the current table of fee coefficients, the rates for office space and retails space are $1.094 and $1.332 per square foot, respectively, while that for residential space of $0.558 per square foot. Based on these rates it is estimated that a total of $136,679 in Downtown DRI supplemental impact fees will be paid. • New construction projects located in the City ,of Miami also need to pay impact fees to Miami -Dade County for roads and schools_ In the eastern portion of the county. the rate for roads for condominiums is $877 per unit. The road impact fee rates for office and retail space in the eastern portion of Miami -Dade County are $1.775 and $2.294, respectively, per square foot for projects with the quantities of space proposed at 888 Brickell Avenue The base fee per unit for school impact fees is $612. An additional amount of $0 918 per square foot is then applied Accordingly, impact fees totaling $265.702 wilt need to be paid at the time the building permit for the proposed project is issued Of this amount, $221.804 will be applied to roads and $43,898 to schools Recurring Fiscal Impacts • The millage rates currently being levied for ad valorem tax purposes by the governmental entities referenced in the Summary of Findings are shown in the table immediately following. The amount collected can not be estimated at this time since it will be dependent on the nature of the businesses housed in the office and retail space. • The City of Miami applies a surtax of 20 percent surtax to all parking charges. The tenants and patrons of the proposed project's retail space and the tenants of its office tenants and their visitors will pay this surtax. The amount of surtax revenues that will be generated can not be estimated at this time. Non -recurring Economic Benefits • It is estimated that approximately 90 percent of the $52.0 million that will be spent on the hard and soft costs to develop the proposed mixed -use project will initially be spent in the City of Miami. This estimate is based on an anticipation of the speck firms that will be involved in implementation of the project. According to the input- output model of Minnesota IMPLAN Group (MIG), which is one of the nation's foremost econometric firms. the overall economic impact of these expenditures will approximate $70.2 million based on application of a 1.5 multiplier. • MIG's input-output model further estimates that approximately $18.9 million of the C moneys spent on hard costs within the City of Miami will be spent for labor.
