City of Miami Office of the City Attorney 444 S.W. 2nd Avenue Miami, Florida 33130-1910 THIS DOCUMENT IS A SUBSTITUTION TO ORIGINAL BACKUP ORIGINAL CAN BE SEEN AT END OF THIS DOCUMENT CORRECTIVE QUIT CLAIM DEED This Corrective Quit -Claim Deed, is made this day of 2008, by the City of Miami, a municipal corporation of the State of Florida, whose post office address is 444 S.W. 2" Avenue, Miami, Florida 33130, hereinafter called the "Grantor", to Habitat for Humanity of Greater Miami, Inc., a Florida not -for -profit corporation, whose address is 3800 NW 22" Avenue, Miami, Florida 33142, hereinafter called the "Grantee". Wiitnesseth: That the Grantor, for and in consideration of the sum of Ten Dollars ($10.00) and other valuable consideration, the receipt of which is hereby acknowledged, does hereby remise, release, convey and quit -claim unto the Grantee forever, all of the Grantor's right, title and interest in that certain land situate in Miami -Dade County, Florida, hereinafter referred to as the "Property", to wit: Lot 1, Block 3, of ORCHARD VILLA, according to the Plat thereof, as recorded in Plat Book 17, at Page 55, of the Public Records of Dade County. Florida, a.k.a. 1290 N.W. 61 Street, Miami, Florida. Subject to: 1. Conditions, restrictions, easements, limitations and reservations of record, though this reference is not intended to reimpose same; 2. Applicable zoning ordinances, codes, rules and regulations; 3. Taxes and assessments for the current year and all subsequent years; 4. The Property is being taken by the Grantee "as is" with the Grantee being solely responsible for the removal of any environmental contamination if present on the Property; THIS CORRECTIVE QUIT CLAIM DEED CORRECTS CONDITION/RESTRICTION NO. 6 STATED IN THAT CERTAIN QUIT CLAIM DEED, DATED OCTOBER 10, 2007, RECORDED OCTOBER 19, 2007, IN OFFICIAL RECORDS BOOK 25997, AT PAGE 4561, OF THE PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA. og- 0Q7n - Cxkib its -Sue THIS DOCUMENT IS A SUBSTITUTION TO ORIGINAL BACKUP ORIGINAL CAN BE SEEN AT END OF THIS DOCUMENT 5. The Grantee and Grantee's beneficiaries agree, for themselves and any successor in interest, that until July 31, 2027, the Property must be occupied only by persons or families whose annual income does not exceed 80% of the median income for the area, as determined by the U.S. Department of Housing and Urban Development, with adjustments smaller and larger families. 6. Title to the Property shall immediately and automatically revert to and vest in the Grantor upon the occurrence of any of the following events: (a) on or before December 31, 2008, the Grantee has not commenced construction, to the satisfaction of the Grantor in its sole judgment, of a minimum of six townhomes on the Property and adjoining properties, or (b) on or before December 31, 2009, all such homes have not been completed (as evidenced by the issuance of Certificates of Occupancy), or such later dates as may be approved by the City Commission of the City of Miami. To Have and To Hold, the same together with all and singular tenements, hereditaments and appurtenances thereto belonging or in anywise appertaining, and all the estate, right, title, interest, lien, equity, and claim whatsoever of the Grantor, either in law or in equity, to the use, benefit and behalf of the Grantee forever.
