HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 08-00858 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A REVOCABLE LICENSE AGREEMENT (THE "AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE VILLAGE OF KEY BISCAYNE, A MUNICIPAL CORPORATION OF THE STATE OF FLORIDA, FOR THE USE OF APPROXIMATELY 3 ACRES OF CITY OF MIAMI OWNED LAND IN VIRGINIA KEY, FOR THE PURPOSE OF STORING NON -HAZARDOUS SOIL AND PIPES RELATED TO ITS PUBLIC WORKS WATER AND SEWER PROJECT, WITH SAID REVOCABLE LICENSE TO BE AT A MONTHLY FEE OF $3,000, FOR THE PERIOD OF 18 MONTHS FROM THE EFFECTIVE DATE, WITH TERMS AND CONDITIONS AS MORE PARTICULARLY SET FORTH IN SAID AGREEMENT; FURTHER AUTHORIZING THE CITY MANAGER TO MAKE NON -SUBSTANTIVE AMENDMENTS TO SAID AGREEMENT AS NEEDED. WHEREAS, the City of Miami ("City") is owner of the tract of land in Virginia Key, Florida, identified by the Village of Key Biscayne ("Licensee"); and WHEREAS, the Licensee is undertaking a public works project that involves excavating non -hazardous sandy soil and installing new water and sewer piping in Key Biscayne (the "Project"); and WHEREAS, the Licensee anticipates that the Project will take approximately eighteen (18) months; and WHEREAS, the Licensee is requesting permission to temporarily store said non -hazardous soil and water and sewer pipes on a City -owned tract of land on Virginia Key during said Project (the "Area"); and WHEREAS, the City and the Licensee have negotiated a Revocable License Agreement ("Agreement") for the use of the Area; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute an Agreement, in substantially the attached form, with the Licensee, for the use of the Area, for the purpose of storing non -hazardous soil and piping materials related to its public works water and sewer project, with said revocable license to be at a monthly fee of $3,000, for a period of 18 months from the effective date, with terms and City of Miami Page 1 of 2 Printed On: 7/14/2008 File Number: 08-00858 conditions as more particularly set forth in said Agreement. Section 3. The City Manager is authorized{1} to make non -substantive amendments to said Agreement as needed. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS: JULIE O. BR CITY ATTORNEY Footnotes: (1) The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. (2) If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
