Subject: Federally Mandated Phase II (Wave 3, Stage 2) Frequency Reconfiguration Project
Purpose of Item:
It is respectfully recommended that the City Commission adopt the attached Resolution, with attachment(s), authorizing
the City Manager to accept funding into the existing Special Revenue Fund entitled: "Frequency Reconfiguration
Program", Account No. 10090.241000.414200.0000.00000 (Project No. 24-110117, Award No. 1332 - See Expense
Accounts in attachment), to receive funding from Nextel South Corporation ("Nextel") pursuant to a federally mandated
Phase II Frequency Reconfiguration Agreement ("Phase II Agreement") for Wave 3, Stage 2 regarding a nationwide
reconfiguration of public safety radio communication systems, with such funding to occur partially soon after the
execution of such Phase II Agreement and partially on a reimbursement basis; authorizing the City Manager to negotiate
and to execute the Phase II Agreement with Nextel, in a form acceptable to the City Attorney, and to negotiate and to
execute an Equipment Exchange Agreement ("Equipment Exchange Agreement") with Motorola, in a form acceptable to
the City Attorney, as required by the Federal Communications Commission ("FCC") and the 800 MHz Transition
Administrator ("Transition Administrator"), and to provide all other necessary documents and certifications, in forms
acceptable to the City Attorney, in order to implement acceptance of and compliance with the Phase II Agreement, the
Equipment Exchange Agreement, and the Phase II frequency reconfiguration processes required by the FCC and the
Transition Administrator; authorizing funding and appropriations on an as -needed, if needed, basis subjec$4 but getary
approvals for various City departments to accomplish the Phase II reconfiguration processes required by thiBCCXnd the
Transition Administrator and to be determined during the Phase II reconciliation processes.

On August 6, 2004, the Federal Communications Commission ("FCC") issued an 800 MHz Report and Order,
FCC 04-168 that modified its rules governing the 800 MHz radio band. On December 22, 2004, the FCC
issued a Supplemental Order and Order on Reconsideration, FCC 04-294. These orders were collectively
referred to as the "Order". The purpose of the Order was to reconfigure the 800 MHz band to minimize harmful
interference to the public safety radio communications system within the band.
Pursuant to the Order, certain licensees of 800 MHz channels used in public safety or other systems, such as the
City of Miami, were to relinquish their existing channels and relocate their systems to other licensed channels
("Replacement Channels"). Also pursuant to the Order, Nextel South Corporation, a wholly -owned indirect
subsidiary of Nextel Communications, Inc. ("Nextel") was to pay relocation expenses. This Order was to be
completed in phases. The first phase known as Wave 3, Phase I, Stage 1 was successfully completed by the
City of Miami.
The City anticipates commencing Wave 3, Phase II, Stage 2 (final phase) during August of 2008. Phase II shall
consist of interoperability reconfiguration with other regional public safety communication systems. Prior to
the Order, the City of Miami entered into Mutual Aid Agreements with compatible regional municipalities. The
Mutual Aid Agreement required cross programming of all the radios in those regions in order to provide
required interoperability. During Phase I, the other regional municipalities had not relocated/rebanded. As a
result of those municipalities complying with the Order, the City may now proceed with interoperability
reconfiguration of its fleet of radios.
Also included in Phase II is the replacement of equipment that became incompatible as a result of the band
restructuring. The attached agreement addresses the equipment replacement proposal and includes the number
of radios, models, and accessories.
