A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR -FIFTHS
(4/5THS) AFFIRMATIVE VOTE, GRANTING AN INCREASED NUMBER OF
CLASS I SPECIAL PERMITS (BEYOND THE TEN (10) SPECIAL EVENTS
ALLOWED PER YEAR), FOR THE ARSCHT CENTER, LOCATED AT 1300
BISCAYNE BOULEVARD, MIAMI, FLORIDA, THROUGH DECEMBER 31, 2008,
TO ACCOMMODATE AN ADDITIONAL TEN (10) EVENTS RELATED TO SAID
ARTS CENTER'S RELATED OR ALLIED SUB -EVENTS.
WHEREAS, the applicable provisions of §906.9 of the Zoning Ordinance of the City of Miami,
Florida, as amended ("Zoning Code"), provide, in part, that (unless approved by a four -fifths (4/5ths)
affirmative vote of the City Commission waiving this requirement) no more than a total of two (2)
temporary events on private property per year, per site, may occur and further that the City
Commission may approve not more than a total of four (4) temporary events per site on private
property per year, by a four -fifths (4/5ths) vote; and
WHEREAS the provisions of the Zoning Code do not permit more than ten (10) temporary
event banners, one (1) for each event per year for public properties; and
WHEREAS, the City of Miami ("City") is committed to enhancing the arts and entertainment
within the City; and
WHEREAS, the size of the banner for each sub -event will be in a manner authorized by
Ordinance No. 11000, as amended, of the Zoning Code, and the Zoning Administrator;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this. Section.
Section 2. By a four -fifths (4/5ths) affirmative vote, an increased number of Class I Special
Permits (beyond the ten (10) special events allowed per year), is granted for the Arscht Center,
located at 1300 Biscayne Boulevard, Miami, Florida, through December 31, 2008, to accommodate
an additional ten (10) events related to said arts center's related or allied sub -events, with each
Class I being subject to review and approval by the Zoning Administrator as set forth in Articles 13
and 14 of the Zoning Code.
Section 3. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor.{1}

{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
