A RESOLUTION OF THE CITY OF MIAMI COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A LAND LEASE, IN
SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI AND
THE UNITED STATES OF AMERICA, ACTING BY AND THROUGH THE
DEPARTMENT OF TRANSPORTATION FEDERAL AVIATION ADMINISTRATION
("LESSEE"), A FEDERAL AGENCY, FOR THE USE OF THE APPROXIMATELY
1.3774 ACRES OR 60,000 SQUARE FEET ON VIRGINIA KEY, MIAMI, FLORIDA,
TO OPERATE A VERY HIGH FREQUENCY OMNI-DIRECTIONAL RANGE AND
TACTICAL AIR NAVIGATIONAL FACILITY, TO PROVIDE FOR A ONE-YEAR
TERM BEGINNING OCTOBER 1, 2008 TO SEPTEMBER 30, 2009, WITH
AUTOMATIC YEAR-TO-YEAR RENEWALS NOT TO EXCEED NINE (9) YEARS
TO SEPTEMBER 30, 2018, UNLESS LESSEE GIVES THIRTY DAYS NOTICE TO
THE CITY OF MIAMI, WITH AN ANNUAL RENT OF $21,500 OR $1,791.67, PER
MONTH, WITH OTHER TERMS AND CONDITIONS MORE PARTICULARLY SET
FORTH IN SAID LEASE.
WHEREAS, the City of Miami ("Lessor") is the owner of certain real property located on Virginia
Key, Miami Florida, which has been occupied by Department of Transportation Federal Aviation
Administration ("FAA") for the operation of a Very High Frequency Omni -Directional Range and
Tactical Air Navigational ("VORTAC") facility site since 1994; and
WHEREAS, Lessor has agreed to continue to lease said property to the FAA consistent with the
terms and conditions set forth herein; and
WHEREAS, a lease provided to another government entity is exempt from the requirements of
Section 29-B of the Miami City Charter; and
WHEREAS, the current FAA Lease No. DTFA06-94-L-13026, Facility: VORTAC, dated June 3,
1994, as amended, will expire September 30, 2008;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized{1} to execute a Land Lease ("Lease"), in substantially
the attached form, between the Lessor and the United States of America, acting by and through the
FAA ("Lessee"), a federal agency, for the use of approximately 1.3774 acres or 60,000 square feet on
Virginia Key, Miami, Florida, to operate a VORTAC facility, for a one-year term beginning October 1,
2008 to September 30, 2009, with automatic year-to-year renewals not to exceed nine years to
September 30, 2018, unless Lessee gives thirty days notice to the City, with an annual rent of $21,500

or $1,791.67, per month, with other terms and conditions more particularly set forth in said Lease.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

{1 } The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was Passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
