Director, Chief City Manager, Final Approvals (SIGN AND DATE) Page 1 of 1 AGENDA ITEM SUMMARY FORM CONTINUED Background Information: Pursuant to Resolution No. 05-0577, adopted September 22, 2005, the Miami City Commission authorized the transfer of 30t'' year Community Development Grant Funds, in the amount of $500,000, and allocated said funds to Neighbors and Neighbors Association, Inc. ("NANA"), for the rehabilitation of the building facades between Northwest 54th and Northwest 58th Street, along Northwest 7th Avenue, Miami, Florida ("Osun Village Project"). WHEREAS, on May 3, 2006, the Agreement between the City of Miami ("City") and NANA was executed with an end term date of May 10, 2008. On March 10, 2008, NANA submitted a written request that the contract be extended to allow for the completion of the Osun Village Project. Due to issues related to obtaining the required permits from the Florida Department of Transportation ("FDOT"), design modifications, encroachment and property quit claim deeds, the project was not completed by the deadline. Properties included in the Osun Village Project were built up to property line on a federal road which requires a master permit be secured through FDOT. NANA asked that the City secure the master permit on their behalf. After carefully evaluating the insurance required and the cost upkeep in securing the permit, the City determined that it was in the best interest if NANA secured the master permit themselves. NANA met with FDOT and City staff and the aforementioned issues were since resolved. The Administration recommends to extend the Agreement end term date, between the City and NANA, from May 10, 2008 to September 30, 2009, with the City retaining the option to extend for an additional year, to allow for the completion of the Osun Village Project and the administration also recommends replacing the declining rate schedule with a five year covenant to comply with federal regulation.
