HomeMy WebLinkAboutLegislation V2City of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 08-00435 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXTEND THE AGREEMENT END TERM DATE, BETWEEN THE CITY OF MIAMI ("CITY")AND NEIGHBORS AND NEIGHBORS ASSOCIATION, INC., FROM MAY 10, 2008 TO SEPTEMBER 30, 2009, WITH THE CITY RETAINING THE OPTION TO EXTEND FOR AN ADDITIONAL YEAR, TO ALLOW FOR THE COMPLETION OF THEE REHABILITATION OF THE BUILDING FACADES FOR BUSINESSES BETWEEN NORTHWEST 54TH AND NORTHWEST 58TH STREET ALONG NORTHWEST 7TH AVENUE, MIAMI, FLORIDA AND AUTHORIZING THE REPLACEMENT OF THE DECLINING RATE SCHEDULE WITH A FIVE YEAR COVENANT;, AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE EXISTING AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH SAID ENTITY, FOR SAID PURPOSES. WHEREAS, pursuant to Resolution No. 05-0577, adopted September 22, 2005, the Miami City Commission authorized the transfer of 30th year Community Development Grant Funds, in the amount of $500,000, and allocated said funds to Neighbors and Neighbors Association, Inc. ("NANA"), for the rehabilitation of the building facades between Northwest 54th and Northwest 58th Street, along Northwest 7th Avenue, Miami, Florida ("Oshun Village Project"); and WHEREAS, on May 3, 2006, the Agreement between the City of Miami ("City") and NANA was executed with an end term date of May 10, 2008; and WHEREAS, on March 10, 2008, NANA submitted a written request that the contract be extended to allow for the completion of the Oshun Village Project; and WHEREAS, due to issues related to obtaining the required permits from the Florida Department of Transportation ("FDOT"), design modifications, encroachment and property quit claim deeds, the project was not completed by the deadline; and WHEREAS, properties included in the Oshun Village Project were built up to property Tine on a federal road which requires a master permit be secured through FDOT; and WHEREAS, NANA asked that the City secure the master permit on their behalf; and WHEREAS, after carefully evaluating the insurance required and the cost upkeep in securing the permit, the City determined that it was in the best interest if NANA secured the master permit itself; and WHEREAS, NANA met with FDOT and City staff and the aforementioned issues were since resolved; and WHEREAS, the Administration recommends to extend the Agreement end term date, between the City and NANA, from May 10, 2008 to September 30, 2009, with the City retaining the option to extend City of Miami Page 1 of 2 Printed On: 6/18/2008 File Number: 08-00435 for an additional year, to allow for the completion of the Oshun Village Project and the administration also recommends replacing the declining rate schedule with a five year covenant to comply with federal regulation; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized {1} to extend the Agreement end term date, between the City and NANA, from May 10, 2008 to September 30, 2009, with the City retaining the option to extend for an additional year, to allow for the completion of the Oshun Village Project and replacing the declining rate schedule with a five year covenant to comply with federal regulation. Section 3. The City Manager is authorized {1} to execute an Amendment to the existing Agreement, in substantially the attached form, with said entity, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
