A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE DE -OBLIGATION OF CITY OF MIAMI DEPARTMENT OF
COMMUNITY DEVELOPMENT AFFORDABLE HOUSING TRUST FUND FUNDS, IN
THE AMOUNT OF $325,000, FROM ALLAPATTAH COMMUNITY ACTION, INC., IN
CONNECTION WITH THE ALLAPATTAH COMMUNITY HOUSING PHASE II
PROJECT; ALLOCATING SAID FUNDS TO THE CITY OF MIAMI DEPARTMENT OF
COMMUNITY DEVELOPMENT AFFORDABLE HOUSING TRUST FUND, FOR THE
DEVELOPMENT OF AFFORDABLE HOUSING, AS SPECIFIED IN EXHIBIT "A,"
ATTACHED AND INCORPORATED; FURTHER AUTHORIZING THE CITY
MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS, FOR SAID
PURPOSES.
WHEREAS, on January 25, 2006, Allapattah Community Action, Inc. ("ACA") was approved by
the United States Department of Housing and Urban Development ("U.S. HUD") to construct 79 units
of housing for the elderly and one for a resident manager under the Section 202 Supportive Housing
Program for the Elderly; and
WHEREAS, pursuant to Resolution No. 06-0711, adopted December 14, 2006, the Miami City
Commission approved the transfer of funds, in the amount of $325,000, from the City of Miami
Department of Community Development Affordable Housing Trust Fund ("AHTF") and allocated said
funds, in the form of a bridge loan, to ACA to cover pre -development costs for the Allapattah
Community Housing Phase II Project, located at 1390 Northwest 24th Avenue, Miami, Florida; and
WHEREAS, pursuant to Resolution No. 07-0455, adopted August 1, 2007, the Miami City
Commission granted ACA an extension of time from August 1, 2007 to March 31, 2008, to make the
required balloon payment to the City of Miami ("City") for the above referenced $325,000 bridge loan;
and
WHEREAS, on September 27, 2007, the City -owned property, located at 1390 Northwest 24th
Avenue, Miami, Florida, was conveyed through a special warranty deed to ACA; and
WHEREAS, due to delays in negotiations with the City, U.S. HUD and ACA, as to the nature of
the security instrument to be used to secure the $325,000 loan compared to the AHTF Guidelines,
closing did not occur; and
WHEREAS, on September 28, 2007, ACA closed the Section 202 grant with U.S. HUD; and
WHEREAS, since ACA has successfully closed said grant, and there is no need for the previously

allocated funds in the amount of $325,000; and
WHEREAS, the Administration recommends the de -obligation of City of Miami Department of
Community Development AHTF funds, in the amount of $325,000, from ACA and the allocation of
said funds to the City Department of Community Development AHTF for the development of
affordable housing;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The de -obligation of City Department of Community Development AHTF, in the amount
of $325,000, from ACA, in connection with the Allapattah Community Housing Phase II Project, and
the allocation of said funds to the City Department of Community Development AHTF, as specified in
Exhibit "A," attached and incorporated, for the development of affordable housing, is authorized.
Section 3. The City Manager is authorized{1} to execute all necessary documents, for said
purposes.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
