A RESOLUTION OF THE MIAMI CITY COMMISSION IN CONNECTION WITH THE
ALLAPATTAH COMMUNITY HOUSING PHASE II PROJECT, GRANTING
ALLAPATTAH COMMUNITY ACTION, INC., AN EXTENSION OF TIME FROM
AUGUST 1, 2007 TO MARCH 31, 2008, TO MAKE THE REQUIRED BALLOON
PAYMENT TO THE CITY OF MIAMI, FOR THE $325,000, BRIDGE LOAN
APPROVED BY THE CITY COMMISSION ON DECEMBER 14, 2006; FURTHER
AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY
DOCUMENTS FOR SAID PURPOSE.
WHEREAS, pursuant to Resolution No. 04-0380, adopted June 10, 2004, the City Commission
declared surplus the City of Miami ("City") owned property located at 1390 Northwest 24th Avenue,
Miami, Florida, and authorized the City Manager to execute a purchase and sale agreement with
Allapattah Community Action, Inc., a non -for -profit corporation ("Allapattah"), for the sale of said
property, and to develop a United States Department of Housing and Urban Development ("U.S.
HUD") elderly housing facility for low, and/or moderate income families and/or individuals, for a
minimum purchase price of $248,141, pending verification of construction cost estimates and to
consummate such transactions in accordance with the terms and conditions of the agreement; and
WHEREAS, Allapattah was approved on January 25, 2006, by U.S. HUD to construct 79 units of
housing for the elderly and one unit for the resident manager under Section 202 Supportive Housing
Program for the Elderly; and
WHEREAS, pursuant to the City Commission meeting held on October 12, 2006, the City
Commission directed the City Manager to draft legislation funding said agency, in the form of a bridge
loan, to prepare the necessary paperwork to close on a Section 202 grant from the U.S HUD; and
WHEREAS, in order to close on the Allapattah Community Housing Phase II Project ("Project"),
said agency requested the amount of $325,000; and
WHEREAS, pursuant to Resolution No. 06-0711, adopted December 14, 2006, the City
Commission approved the transfer of funds in the amount of $325,000, from the Affordable Housing
Trust Fund and allocated funds in the form of a bridge loan to Allapattah to cover pre -development
costs for the Project; and
WHEREAS, Allapattah has yet to close on the U.S. HUD loan due to delays from U.S. HUD; and
WHEREAS, U.S. HUD has advised the City that said loan will not be closed by August 1, 2007;
and
WHEREAS, the Administration is recommending granting Allapattah an extension of time from
August 1, 2007 to March 31, 2008, to make the required balloon payment to the City for the $325,000,
bridge loan approved by the City Commission on December 14, 2006;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORI DA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The Miami City Commission grants, in connection with the Project, Allapattah an
extension of time from August 1, 2007 to March 31, 2008, to make the required balloon payment to the
City for the $325,000, bridge loan approved by the City Commission on December 14, 2006.
Section 3. The City Manager is further authorized {1} to execute the necessary documents for said
purpose.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
