HomeMy WebLinkAboutCC Legislation (Version 2)y o r� I Legislation Resolution 3500 Pan American 133 www.mia-mi v.com File Number: 08-0 S 76:c Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION WITH ATTACHMENT(S) APPROVING A SPECIAL EXCEPTION, REQUIRING CITY COMMISSION APPROVAL, AS LISTED IN ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, ARTICLE 4, SECTION 401, UNDER CONDITIONAL PRINCIPAL USES IN PR PARKS, RECREATION AND OPEN SPACE DISTRICT, TO ALLOW THE CONSTRUCTION OF A NEW CLUBHOUSE WITH RESTAURANT, BAR AND RETAIL SPACE, FOR THE PROPERTY LOCATED AT APPROXIMATELY 1802 NORTHWEST 37TH AVENUE, MIAMI, FLORIDA. WHEREAS. the Miami Zoning Board, at its meeting on June 9, 2008, Rem No. Z.1, following an advertised public hearing, adopted Resolution No. ZB-08-049 by a vote of four to one (4-1) vote, recommending APPROVAL of a Special Exception requiring City Commission approval as set forth with the following conditions: 1) The Applicant shall present ail final design details, including but not limited to, architectural plans, site plan, elevations and floor plans for the review and approval of the Planning Department prior to the issuance of any building permit; 2) A complete landscape plan, including a tree removal and mitigation plan with specifications, must be submitted for the review and approval of the Planning Department prior to the issuance of any building permits, 3) Clubhouse, restaurant, bar and retail space shall remain permanently controlled by the City of Miami; and 4) No alcoholic beverages are permitted ; and WHEREAS, Zoning Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, requires City Commission approval of the Special Exception as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter finds the application for the Special Exception meet the applicable requirements of Zoning Ordinance No. 11000, as amended, and deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant the Special Exception as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Special Exception as listed in Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Article 4, Section 401, under conditional principal uses in parks, recreation and open space district, to allow the construction of a new clubhouse with restaurant, bar and retail space, for the property located at approximately 1802 Northwest 37th Avenue, Miami, Florida, legally described in attached "Exhibit A," pursuant to plans on file and subject to a time limitation of twelve (12) months in which a building permit must be obtained, and the Special Exception City of r i arni Page 1 of 6 Printed On: 6/13/2008 Fife Number: 98-00576xe granted. Section 3. The findings of fact set forth beicw are made with respect to the subject property: a. BRU CITY ATTORNEY 9ediateiy upon its adoption and signature of Footnotes {1} if the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. if the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
