HomeMy WebLinkAboutR-08-0371City of Miami Legislation Resolution: R-08-0371 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 08-00405xc Final Action Date: 6/26/2008 A RESOLUTION OF THE MIAMI CITY COMMISSION WITH ATTACHMENT(S) APPROVING A SPECIAL EXCEPTION, REQUIRING CITY COMMISSION APPROVAL, AS LISTED IN ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, ARTICLE 6, SECTION 612, SD-12 SPECIAL BUFFER OVERLAY DISTRICT, CONDITIONAL ACCESSORY USES, TO ALLOW SURFACE PARKING TO SERVE THE ABUTTING DISTRICT, SUBJECT TO ALL APPLICABLE CRITERIA, WITH A TIME LIMITATION OF TWELVE (12) MONTHS IN WHICH A BUILDING PERMIT MUST BE OBTAINED SUBJECT TO CONDITIONS, FOR THE PROPERTIES LOCATED AT APPROXIMATELY 2209 SOUTHWEST 37TH AVENUE, 3670 SOUTHWEST 22ND STREET AND 3671 SOUTHWEST 22ND TERRACE, MIAMI, FLORIDA. WHEREAS, the Miami Zoning Board, at its meeting on May 19, 2008, Item No. 2, following an advertised public hearing, adopted Resolution No. ZB 08-041 by a vote of seven to zero (7-0) vote, recommending APPROVAL with conditions of a Special Exception requiring City Commission approval as set forth; and WHEREAS, Zoning Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, requires City Commission approval of the Special Exception as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter, including the recommendation of the Zoning Board, finds the application for the Special Exception meet the applicable requirements of Zoning Ordinance No. 11000, as amended, NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Special Exception as listed in Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Article 6, Section 612, SD-12 Buffer Overlay District, to allow surface parking to serve the abutting district for the properties located at approximately 2209 Southwest 37th Avenue, 3670 Southwest 22nd Street and 3671 Southwest 22nd Terrace, Miami, Florida, legally described in attached "Exhibit A" is approved, pursuant to plans on file and subject to a time limitation of twelve (12) months in which a building permit must be obtained, and the Special Exception granted. Section 3. The Internal Design Review Committee made recommendations on April 1, 2008, as to the urban design and landscaping of the properties as follows: a) the Western and Southern rows of the surface parking lot to conform to the City of Miami Off -Street Parking guides and standards which City of Miami Page 1 of 6 File Id: 08-00405xc (Version: 21 Printed On: 5/8/2017 File Number: 08-00405xc Enactment Number: R-08-0371 require that for each row of parking there shall be a minumim of two (2) landscape areas with trees within the first ninety (90) linear feet and one (1) landscape area with a tree for each additional ninety (90) linear feet; b) include glass for the window openings above the Southern entrance door considering that no liner will be provided; c) more plantings are necessary in order to screen the surface parking area and drive thru from view from the neighboring properties. Enhance all of the landscape buffers along site perimeters by providing layers of plantings including trees, palms, shrubs, and ground cover and curb and gutter be placed along Southwest 22nd Terrace; and are incorporated herein as conditions to the granting of this special exception. Section 4. The findings of fact set forth below are made with respect to the subject property: a. Pursuant to Section 1305.2 of the Zoning Ordinance, the specific site plan aspects of the project that have been found by the City Commission (based upon facts and reports prepared or submitted by staff or others) to adhere to the following Design Review Criteria subject to the any applicable conditions herein: (I) Site and Urban Planning: Design Review Criteria Applicability Compliance (1) Respond to the physical Yes. *Yes. contextual environment taking into consideration urban form and natural features; (2) Sitting should minimize the Yes. *Yes. impact of automobile parking and driveways on the pedestrian environment and adjacent properties; (3) Buildings on corner Yes. *Yes. lots should be oriented to the corner and public street fronts. (VIII) Preservation of Natural Features: Design Review Criteria Applicability (1) Preserve existing vegetation N/A and/or geological features whenever possible. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
