Subject: Extension of the City Manager's Authority to grant noise waiver to film productions
Purpose of Item:
Extend manager's (previously granted) authority to waive the noise ordinance for film productions for
an additional 90 day period.
Background Information:
Back in March, City Commission approved a resolution which granted the City Manager the authority
to waive the noise ordinance for film productions for a 90 day period which ended on May 31, 2008.
This new resolution is to seek an extension of that original 90 day period to begin June 1, 2008 until
August 31 st, 2008.

A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY
MANAGER TO GRANT WAIVERS OF THE NOISE RESTRICTIONS CONTAINED
IN SECTIONS 36-4 AND 36-5 OF THE CODE OF THE CITY OF MIAMI, FLORIDA,
AS AMENDED, FOR AN ADDITIONAL NINETY (90) DAY PERIOD COMMENCING
ON JUNE 1, 2008, TO FACILITATE THE FILMING OF MOTION PICTURE
PRODUCTIONS WITHIN THE CITY OF MIAMI.
WHEREAS, the City of Miami ("City") continues to enjoy unprecedented growth and
development, and the film industry continues its growth as a viable and important sector of our local
economy; and
WHEREAS, several film productions wish to film motion pictures, either in their entirety or in
parts, within the City; and
WHEREAS, the current noise restrictions found in Sections 36-4 and 36-5 of the Code of the
City of Miami, Florida, as amended ("City Code"), prohibit film productions from filming any scenes that
would violate those restrictions; and
WHEREAS, the nature of the film industry prevents the film productions from timely requesting
waivers directly from the City Commission; and
WHEREAS, this Resolution will not allow the film productions carte blanche to violate the noise
restrictions, but rather those film productions seeking waivers will be required to request a waiver from
the City Manager for each and every instance of filming that will violate the noise restrictions; and
WHEREAS, the Mayor's Office of Film and Cultural Affairs will work hand -in -hand with the film
productions to guarantee that every affected area, including businesses and area residents, are
properly notified and that disruptions arising from filming are as minimal as possible; and
WHEREAS, in Resolution 08-0102 adopted February 28, 2008, the City Commission
authorized the City Manager to grant waivers to the noise restrictions found in Sections 36-4 and 36-5
of the City Code through May 31, 2008; and
WHEREAS, additional time is needed to finalize the current film productions taking place within
the City; and
WHEREAS, the City Manager's authority to grant waivers to the noise restrictions found in
Sections 36-4 and 36-5 of the City Code will be limited to a ninety (90) day period commencing on
June 1, 2008;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is hereby given the authority to grant waivers to the noise
restrictions found in Sections 36-4 and 36-5 of the City Code for a ninety (90) day period commencing
on June 1, 2008, to film productions that specifically request a waiver on their film permit application.
Section 3. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor.{1}

{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days

RECOMMENDATION
It is respectfully recommended that the City Commission grant City Manager, Pedro G.
Hernandez, the authority to grant waivers to the noise ordinance for a 90-day period
commencing June 1, 2008.
The purpose of this waiver is to facilitate the filming of various film projects, including
USA's Network, Burn Notice, and an untitled project directed by Sam Mendes.
BACKGROUND
The authority to grant waivers, by the City Manager for a 90-day period, was previously
approved by the City Commission at the March 13th, 2008 meeting. This request is an
extension of that authority for an additional 90 days, which would cover any requests
from June 1st through August 31 st, 2008.
With the approval of the City Commission, the City Manager will be able to grant
waiver(s) as necessary during the aforementioned time period. The production
companies will proceed with the usual permitting process and review of each waiver
request, as specific locations are needed, with the Mayor's Office of Film & Cultural
Affairs.
The Mayor's Office of Film & Cultural Affairs will ensure that all affected residents, city
agencies, commercial businesses, and/or civic organizations are fully aware of the
scheduled filming in their area and that every effort is taken to ensure that filming
activity will cause no (or minimal) disruption to the community.
