HomeMy WebLinkAboutLegislation V1City of Miami Legislation Ordinance City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 08-00531 Final Action Date: AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 38 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "PARKS AND RECREATION," BY AMENDING SECTION 38-66, TO ESTABLISH EXCEPTIONS FOR THE PLACEMENT OF SIGNS WITHIN PARK LIMITS; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Miami ("City") has a substantial and significant interest in maintaining its parks in an attractive condition, readily available to the residents and visitors who seek to enjoy them; and WHEREAS, in keeping with those interests, it is the intent of the City Commission to allow signs in City parks, when a particular situation allows for the collection of funds that will assist the City in maintaining its parks in an attractive condition; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted and incorporated as if fully set forth in this Section. Section 2. Chapter 38 of the Code of the City of Miami, Florida, as amended, is amended in the following particulars:{1} "Chapter 38 PARKS AND RECREATION ARTICLE II. USE REGULATIONS Sec. 38-66. Advertising and signs. No signs or advertising shall be posted within park limits other than those erected by the parks and recreation department, except signs authorized or required by the City, or by the laws of the United States, the State of Florida, or the City, or as approved by the City Commission, or as allowed by any settlement agreement. Bulletin boards are exclusively for official park business. Items not related to the park or recreational programs shall not be placed on the bulletin boards. All Ordinances or parts of Ordinances that are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 4. If any section, part of a section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof.(2} APPROVED AS TO FORM AND CORRECTNESS: JULIE O. Asterisks indicate omitted and unchanged material. {2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
