A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY
MANAGER TO GRANT WAIVERS OF THE NOISE RESTRICTIONS CONTAINED IN
SECTIONS 36-4 AND 36-5 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, FOR AN ADDITIONAL NINETY (90) DAY PERIOD COMMENCING ON
JUNE 1, 2008, TO FACILITATE THE FILMING OF MOTION PICTURE
PRODUCTIONS WITHIN THE CITY OF MIAMI.
WHEREAS, the City of Miami ("City") continues to enjoy unprecedented growth and
development, and the film industry continues its growth as a viable and important sector of our local
economy; and
WHEREAS, several film productions wish to film motion pictures, either in their entirety or in
parts, within the City; and
WHEREAS, the current noise restrictions found in Sections 36-4 and 36-5 of the Code of the
City of Miami, Florida, as amended ("City Code"), prohibit film productions from filming any scenes
that would violate those restrictions; and
WHEREAS, the nature of the film industry prevents the film productions from timely requesting
waivers directly from the City Commission; and
WHEREAS, this Resolution will not allow the film productions carte blanche to violate the
noise restrictions, but rather those film productions seeking waivers will be required to request a
waiver from the City Manager for each and every instance of filming that will violate the noise
restrictions; and
WHEREAS, the Mayor's Office of Film and Cultural Affairs will work hand -in -hand with the film
productions to guarantee that every affected area, including businesses and area residents, are
properly notified and that disruptions arising from filming are as minimal as possible; and
WHEREAS, in Resolution 08-0102 adopted February 28, 2008, the City Commission
authorized the City Manager to grant waivers to the noise restrictions found in Sections 36-4 and 36-5
of the City Code through May 31, 2008; and
WHEREAS, additional time is needed to finalize the current film productions taking place
within the City; and
WHEREAS, the City Manager's authority to grant waivers to the noise restrictions found in
Sections 36-4 and 36-5 of the City Code will be limited to a ninety (90) day period commencing on
June 1, 2008;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is hereby given the authority to grant waivers to the noise
restrictions found in Sections 36-4 and 36-5 of the City Code for a ninety (90) day period commencing
on June 1, 2008, to film productions that specifically request a waiver on their film permit application.
Section 3. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor.{1}
Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City.
