HomeMy WebLinkAboutR-08-0297City of Miami Legislation Resolution: R-08-0297 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 08-00575 Final Action Date: 5/22/2008 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI AND DAUB FIRMIN HENDRICKSON SCULPTURE GROUP, LLC, IN AN AMOUNT NOT TO EXCEED $200,000, FOR THE CREATION OF A STATUE HONORING JULIATUTTLE, TO BE PLACED ON THE MIAMI RIVER WALK; ALLOCATING FUNDS FROM AN ACCOUNT TO BE DETERMINED BY THE CITY MANAGER FOR SAID PURPOSE. WHEREAS, Julia Tuttle was the pioneer and visionary who recognized the City of Miami ("City") as a great city and convinced Henry Flagler to extend his railroad to Miami, leading to the City's Incorporation in 1896; and WHEREAS, the City Commission desires to acknowledge and honor Julia Tuttle's contribution to the City by commemorating her memory with a statute bearing her image; and WHEREAS, on February 24, 2005, the City Commission unanimously adopted a motion supporting the concept of placing a statue of Julia Tuttle in an appropriate location near her home, and further stated that the majority of the fundraising should come from private fundraising efforts; and WHEREAS, the Julia Tuttle Committee has raised the total amount of $196,350, from both public and private donations; and WHEREAS, the funds raised by the Julia Tuttle Committee will be used to create the statue of Julia Tuttle, and to maintain the statue after its creation; and WHEREAS, Section 18-72 of the Code of the City of Miami, Florida, as amended, excludes artistic services or works of art from the requirements of the City of Miami Procurement Ordinance; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute an agreement, in substantially the attached form, between the City and Daub Firmin Hendrickson Sculpture Group, LLC, in an amount not to exceed $200,000, for the creation of a statue honoring Julia Tuttle, with funds allocated from an account to be determined by the City Manager for said purpose. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
