WH47E Our firm represents The First Spanish United Presbyterian Church of Miami, Inc., a Florida not -for -profit corporation (the "Church") and La Progresiva Presbyterian School, Inc., a Florida not -for -profit corporation (the "School"). The Church and the School wish to modify the Unity and the Declaration. as provided for below. Both the Unity and the Declaration require that any modifications be approved by the City of Miami Commission after a public hearing. The purpose of this letter is to request a public hearing before the City of Miami Commission to modify the Unity and the Declaration for the reasons outlined in this letter, we believe that the modification is justifiable and should be approved. Background, The Churn.°l.a owns the properties legally described in the attached Exhibit "A" (the "Church Property'). The School owns the properties legally described in the attached Exhibit Ms.. 17 restvA . March 5, 2008 a e 2 :z "School Property" ), The School and. Church Properties shall be co.lect i.v e.ly referred to as the lPoperties. On larch 27, 1995, the City of .Miami Commission passed and adopted Resolution 95- 249 (the "Resolution"), The Resolution granted a special exception to allow a primary and secondary school on the Properties, specifically on lots 7 and 8 in Block 2, Indian .Heights, according to the flat thereof, as recorded in Plat Book 12, Page 7 and Lots 4 and 5, Block 1, .Indian Heights 2" Section, according to the Plat thereof, as recorded in Plat Book 19, Page 52, all in the Public Records of.Miami-Dade County, Florida (the "To Be Released Properties"). The To Be Released Properties have a street address and folio numbers as follows: i) 600 NW 24 Avenue, Miami, Florida, Folio #01-4103-027-0150 and ii) 2455 NW 6 Street, Miami, Florida, Folio #01-4103-042-0220. The To Be Released Properties are zoned R-2 (Duplex). The To Be Released Properties are descried as parcels E and D on the enclosed site plan. Condition No. 1 to the Resolution required a unity of title on the Properties. The Resolution also required a declaration of restrictions be placed on the Properties setting forth all of the conditions outlined in the Resolution. in accordance with the Resolution, the School and Church filed a Unity of Title, recorded in Official Records Book 16929, Page 4177 (the "Unity") and a Declaration of Restrictions recorded in Official Records Book 16929, Page 4180 (the "Declaration") all in the Public Records of Miami -Dade County, Florida. Even though the Resolution approved a school use on the To Be Released Properties, the Church and the School have never used the To Be .Released Properties for that purpose, in fact they have always remained as residential duplexes. The Church and the School have no intentions now or in the future to use the To .Be Released Properties as a school. Therefore, the School and the Church are requesting the following: 2. Partial Release of the Unity as it pertains to the To Be Released Properties. Partial Release of the Declaration as it pertains to the To Be Released Properties. 3.
