PARTIAL LEASE OF
UNITY OF TITLE
This is a Partial Release of Unity of Title (the `Partial" Release").
Recitals
A, On March 27, 1995, the City of Miami Commission passed and adopted
Resolution 95-249 (the "Resolution") Exhibit "B". Condition #1 of the Resolution required
that a Unity of Title be placed on the property legally described in Exhibit "A" (the
"Property").
B. In accordance with the Resolution a Unity of Title was placed on the Property
and recorded in Official Records Book 16929, Page 4177, of the Public Records of Miami -
Dade County, Florida (the "Unity")
C. Paragraph 2 of the Unity requires that any releases be "in writing by the
Planning, Building and Zoning Department of the City of Miami or its Director or the
designated representative; providing that said release has been approved by the Commission of
the City of Miami after a public hearing..."
D. La Progresiva Presbyterian School, Inc., a Florida not -for -profit corporation
(the "School") and The First Spanish Presbyterian Church of Miami, Inc. a Florida not -for -
profit corporation (the "Church") as owners of the Property have made an application to the
City of Miami for the release of the property legally described in Exhibit "C" from the Unity
(the "To Be Released Property").
E. On 2008 the City of Miami Commission passed and
adopted Resolution No. approving the release of the To Be Released Property from
the Unity (the "Releasing Resolution").
NOW THEREFORE,
i. :Pursuant to the Resolution and the Releasing Resolution, thy; Zoning
Administrator of the Panning and Zoning Department hereby releases the To Be Released
Property f rrom the Unity.
