R-07-0289, AS LISTED IN ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, TO ALLOW AN EXTENSION OF TIME FOR THE ORIGINAL SPECIAL EXCEPTION APPLICATION (06-00799xc) AS MODIFIED BY RESOLUTION NO. R-07-0289, WHICH INCREASED THE SQUARE FOOTAGE AS DESCRIBED THEREIN, WITH A TIME LIMITATION OF TWELVE (12) MONTHS IN WHICH A BUILDING PERMIT MUST BE OBTAINED SUBJECT TO CONDITIONS, FOR THE PROPERTIES LOCATED AT APPROXIMATELY 1603-27 NORTHWEST 7TH AVENUE AND 662 NORTHWEST 20TH STREET, MIAMI, FLORIDA. WHEREAS, the Miami Zoning Board, at its meeting on May 12, 2008, Item No. 2, following an advertised public hearing, adopted Resolution No. ZB-08-039 by a vote of five to one (5-1) vote, recommending APPROVAL with conditions of an extension of time for a Special Exception requiring City Commission approval as set forth; and WHEREAS, Zoning Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, requires City Commission approval of this Special Exception as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter finds that there is sufficient cause to grant a one (1) year extension for this Special Exception; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission hereby approves a one (1) year extension of time for a special exception, granted by the City Commission on May 24, 2007, by Resolution No. R-07-0289, as listed in Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, to allow an extension of time of one (1) year for the original special exception application (06-00799xc), as modified by Resolution No. R-07-0289, which increased the square footage as described therein, for the properties located at approximately 1603-1627 Northwest 7th Avenue and 662 Northwest 20th Street, Miami, Florida legally described in attached "Exhibit A," pursuant to plans on file and subject to a time limitation of twelve (12) months in which a building permit must be obtained, and the Special Exception granted. Section 3. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
