AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER
10/ARTICLE I/ SECTION 10-4, OF THE CODE OF THE CITY OF MIAMI, FLORIDA,
ENTITLED "BUILDINGS/IN GENERAL/BUILDING PERMIT FEE SCHEDULE," MORE
PARTICULARLY BY AMENDING SECTION 10-4(B)(4) TO ADD DEFINITIONS AND
SECTIONS "G -J" TO ESTABLISH A MEANS OF PROVIDING EXPEDITED SERVICE
FOR PLANS REVIEW FOR GREEN BUILDINGS THAT MEET THE UNITED STATES
GREEN BUILDING COUNCIL STANDARDS; CONTAINING A SEVERABILITY
CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, during the past five (5) years, the City of Miami ("City") has launched a
comprehensive and aggressive environmental program to clean streets, waterways, brownfields,
storm drains, and improve air and water quality, thus erasing decades of environmental neglect; and
WHEREAS, on April 26, 2007, the City approved a Resolution supporting the Climate
Protection Agreement committing the City to take actions to reduce global warming pollution by
striving to meet or exceed Kyoto Protocol targets; and
WHEREAS, the United States ("U.S.") building sector has been shown to be a major producer
of global warming causing greenhouse gases; and
WHEREAS, in determining whether a structure is a green building, the Building Director or
designee, with the Miami Office of Sustainability Initiatives, shall rely on the review, evaluation and,
where available, registration or certification of the design by environmental rating agencies such as
the U.S. Green Building Council; and
WHEREAS, the large positive impact on employee productivity and health gains suggests that
green building is cost-effective beyond utility bill savings alone; and
WHEREAS, the City wishes to add an incentive for building green; and
WHEREAS, Section 10-4(b)(4)f of Chapter 10 of the Code of the City of Miami, Florida, as
amended ("City Code"), establishes the fees and means for obtaining expedited plans review service
for "special projects" as such inducement; and
WHEREAS, the City has established a standardized fee schedule for permits and plan
reviews; and
WHEREAS, a clause for expedited service exists within the standardized fee schedule; and
WHEREAS, the City wishes to include "Green Buildings" into the criteria for expedited service;
and

WHEREAS, the City wishes to establish an in-house expedited review process for Green
Buildings that are designed to meet the minimum requirements defined by this Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and finding contained in the Preamble to this Ordinance are adopted
by reference and incorporated as if fully set forth in this Section.
Section 2. Chapter 10/Article I/Section 10-4(b)(4) of the City Code, entitled "Buildings/In
General/Building permit fee schedule" is amended in the following particulars:{1}
"CHAPTER 10
BUILDINGS
ARTICLE 1. IN GENERAL
Sec. 10-4. Building permit fee schedule.
(b) General fees: minimum fee.
(4) Recertification of plans and revised plans fee; permit card replacement.
Exaedited Plans Review Service for Green Buildinas.
Green Buildings are defined as those with resource efficient design, construction, and operation by
employing environmentally sensible construction practices, systems, and materials and defined as
residential or commercial buildings that are registered Leadership in Energy and Environmental
Design GLEED") projects.
LEED is defined as the most recent Leadership in Energy and Environmental Design Rating System
of the U.S. Green Building Council.
Expedited priority review of permit applications shall be defined as those to be reviewed prior to
non -green building applications, in the order received, within the building permit review process . A
refundable deposit, described in paragraph i will be required.
h. Green buildings eligible for priority permitting will be:

1. For buildings in excess of 50,000 square feet, and that exceed the requirements of
LEED Silver certification
2. For buildings below 50,000 square feet, and that meet or exceed the requirements for
anv level of LEED certification.
j. To qualify for expedited priority review and approval of permit applications, buildings
meetina the criteria above must submit to the Buildina Deaartment:
1. A LEED Registration Form,
2. A LEED Scorecard indicating all expected rating points, and
3. The name and contact information for a LEED Accredited Professional on the project
team.

Section 3. If any section, part of a section, paragraph, clause, phrase or word of this Ordinance is
declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective thirty (30) days after final reading and adoption
thereof.{2}

{2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date
stated herein, whichever is later.
