Miami 21 Zoning Code

This memorandum seeks your approval and adoption of the below described Emergency
Finding justifying the waiver of competitive procurement procedures and the selection of
the consultants identified herein to provide the requested additional planning services for
the Miami 21 Zoning Code.
EMERGENCY FINDING
FINDINGS
• Resolution 02-19, adopted January 10, 2002 accepted the recommendation of the
City Manager to approved the finding of the Selection Committee pursuant RFPs
that the most qualified firms to provide professional Town Planning and Urban
Design Services for Public Works category "B" included the firm of Duany
Plater- Zyberk and Co. to provide Town Planning / Urban Design Services for an
amount not to exceed $600,000.
• Resolution 03-159, adopted February 13, 2003, authorized the City Manager to
execute a Professional Services Agreement with the firm of Duany Plater-Zyberk
and Co. in amount not to exceed $250,000.00 for prepare a Regulating Plan for
the Florida East Coast Corridor (FEC Corridor) (First Work Order).
• On May 27, 2004 via Resolution R04-0348, the Miami City Commission
amended Resolution 02-19 and authorized the City Manager to increase the
Professional Services Agreement to an amount not to exceed $2,300,000 to
engage in the project entitled "Miami Master Plan", currently known as Miami
21. This new work order for an amount not to exceed $1,700,000 is intended to
provide a New Zoning Code, City-wide Economic Development study and a
Transportation Analysis.
• Proposed Second Amendment would increase the Second Work Order amount by
approximately $510,000 for a new Second Work Order amount not to exceed
$ 2,210,000.00. Said increase would address additional Scope of Services as
requested by City Administration and Elected Officials that includes
approximately 90 additional meetings to date. Meetings with Civic and Home
Owners' associations such as MNU, and Edgewater as well as meetings with
development industry representatives that include Land Use Attorneys,

Architects, Developers and hold additional meetings, workshops and work -
sessions for Planning Advisory Board, Six Commissioners, 3 for District 2 and 3
for District 5, and two City Managers, to date.
• Update of Public Benefits Component and Marketing Study for Economic
Component.
• Said second amendment would also address additional Scope of Services as
requested by City Commission on June 28th, 2007, that included a Comparative
Study of Zoning Ordinance 11000 to the proposed New Zoning Code, 15 District
meetings and 14 meetings with City Administration and Elected Officials and
provide necessary funding for services related to the Economic and Public
Benefits components for the remaining three Quadrants.
• Therefore ,the City of Miami proposes to select Duany Plater-Zyberk &
Company, LLC formerly known as Duany Plater-Zyberk & Company, Inc.,
Master Planners and Prime Consultant, to provide additional Town Planning,
public meetings, and Urban Design services for the Miami 21 Master Plan, since
the effect that the time required for the competitive procurement process, award
and negotiation of contract and the need for consistency in the project creates an
undue hardship on the public welfare, thus it is in the best interest of the public to
waive competitive procurement procedures.
• Therefore, the aforementioned firm has been investigated and is found to have
excellent qualifications distinctly geared to the aforementioned project and a
substantial record of experience in projects of like size and complexity. It has
been further determined that said firm is appropriately licensed and certified as
consultants uniquely qualified to undertake and perform the required work on
behalf of the City.
ACTIONS
1. This action is being considered pursuant to Florida Statutes 287.055 (Consultant's
Competitive Negotiation Act) and Sections 18-85 (Competitive Sealed
Bidding/Waiver Procedures), 18-87 (Professional Services as defined in F.S.
Section 287.055) and 18-90 (Emergency Procurements) of the Code of the City of
Miami, as amended. The criteria to be considered in this matter are set forth in the
proposed resolution and in these Code sections and in F.S. Section 287.055,
which are deemed to be incorporated by reference herein and are available as
public records from the City of Miami.

2. The Department has determined that the most expeditious method of providing
the requested additional services and provide consistency in the project is to
engage the existing Provider (Duany Plater-Zyberk & Company, LLC formerly
known as Duany Plater-Zyberk & Company, Inc.), in an effort to effectively
incorporate the proposed additional work products and services into the overall
Miami 21 project.

Manager / inistrative Officer of the City of Miami.
