It is respectfully recommended that the City Commission adopt the
attached resolution authorizing the City Manager to execute
individual contractual agreements, in a form acceptable to the
City Attorney, with Economic Opportunity Family Health Center,
Inc., Lock Towne Community Mental Health Center, Inc., and
Christian Community Service Agency, in connection with the
acquisition, rehabilitation and/or operation of rental housing
units affordable to persons with HIV/AIDS, or related diseases.
The attached resolution further directs the City Manager to
disburse funding in the amounts stated in Section 2 of the
attached resolution. Funding for this activity is being provided
by the U.S. Department of Housing and Urban Development in
connection with the Housing Opportunities for Persons with AIDS
(HOPWA) Program (FY' 1993).
In February of 1993, the City of Miami, on behalf of Metropolitan
Dade County and the cities of Hialeah, and Miami Beach, applied
for $4,697,000 in Housing Opportunities for Peraone With AIDS
(HOPWA) Program funding from U.S. HUD. In April of 1993, the
City was notified by U.S. HUD that its application for $4,697,000
in HOPWA Program funding had been approved.
At the May 13, 1993 City Commission meeting, the City Commission
through Resolution No. 93-287, authorized the City Manager to
accept the $4,697,000 HOPWA Grant from U.S. HUD and to execute
the necessary agreements and documents for implementation of the
HOPWA Program.
In June of 1993, the Department of Development and Housing
Conservation advertised for proposals from local area AIDS
service providers/sponsors for the purpose of providing housing
related assistance to individuals with HIV/AIDS or related
diseases in connection with the HOPWA Program. On August 16,

1993, the proposals submitted in response to the City's
advertisement were reviewed by the HOPWA Working Advisory
Committee, consisting of representatives from Metropolitan Dade
County, the cities of Miami, Miami Beach, Hialeah, the Miami
Coalition For The Homeless, Cure AIDS Now, the Health Council of
South Florida, and the Dade Partnership for Community and
Economic Development.
Subsequently, on November 4, 1993, the HOPWA Working Advisory
Committee held a public hearing, which hod been advertised in the
Miami Herald, the Miami Times, and the Diario Las Americas, in
order to solicit public input, which included input from public
officials representing their local jurisdictions regarding the
various housing proposals being considered by the HOPWA Working
Advisory Committee for HOPWA Program funding.
Based on the proposals which were received and the
recommendations of the HOPWA Working Advisory Committee, the
Department of Development and Housing Conservation recommends the
following project sponsors for funding in the amounts listed
below, for the acquisition, rehabilitation and operation of
rental housing units affordable to individuals with HIV/AIDS or
related diseases in connection with the HOPWA Programs

BACKGROUND:
In December 1993, the City of Miami awarded Housing Opportunities for Persons with AIDS
(HOPWA) Program funds to Locktowns Community Mental Health to acquire, rehabilitate and
operate eighteen (18) units of rental housing for low income persons with AIDS, known as the
Life Quest Facility. The project includes properties located at 1301 N.E. 111th Street; 14950-52
N.E. 13th Avenue; 1075 N.E. 149th Street; 1096-97 N.E. 149th Street; and 14950-52 N.E..11th
Avenue and is composed of six (6) efficiencies, nine (9) one -bedroom units and three (3) two -
bedroom units.
The Public Health Trust assumed responsibility for the management of the Life Quest Facility
from February 2003 through December 31, 2003, with the understanding that the City would find
a replacement project sponsor to take over at the end of that period. In October 2003, the City of
Miami issued a HOPWA Request for Proposals (RFP) for a new project sponsor to assume
ownership of the Life Quest Facility and design and operate a supportive housing program
targeting low-income persons living with AIDS.
On December 18, 2003, the City of Miami Commission approved the transfer of ownership of
the Life Quest Facility to Minorities Overcoming the Virus through Education, Responsibility,
and Spirituality Inc. (MOVERS, Inc.) for the operation of a supportive housing program for low-
income persons with AIDS and allocated $150,000 of Fiscal Year 2003-2004 HOPWA funds for
its rehabilitation. At the same time, an additional $100,000 in HOPWA funds were allocated for
the operation of the facilities. The funding allocation is contingent upon Housing and
Commercial Loan Committee approval.
DEPARTMENT RECOMMENDATION:
The Department recommends approval of $150,000 in HOPWA funds to MOVERS, Inc. for
rehabilitation of the Life Quest Facility, an eighteen (18) unit project for the purpose of operating
the MOVERS Supportive Housing Program (see attached Loan Evaluation).
The terms and conditions are recommended as follows:
1. A fifteen (15) year affordability period of use restricted to housing only for low-
income persons with AIDS;
2. The Project Sponsor shall agree to execute and record a Declaration of Restrictive
Covenant with the appropriate reverter clause on each parcel of property immediately
upon transfer of the subject properties from Locktowns Community Mental Health to
MOVERS, Inc.;
3. All HOPWA units will be made available to prospective tenants referred by the City
of Miami. MOVERS, Inc. must request City approval, in writing, before rejecting a
City -referred tenant and must keep the City informed of the status of vacancies in the
facility;
4. On -going maintenance of the properties must, at all times, comply with local, state
and federal housing standards, including the local housing quality standards
established under the HOPWA Program;
5. All housing units will be subject to annual inspection by the City of Miami. The units
may also be subject to inspection upon request by residents of the housing program;
6. The City of Miami reserves the right to withhold funds in the event that one or more
units fail inspection; and
7. The HOPWA unit will be rented at 30% of the individual's monthly adjusted income.

If Movers, Inc. is able to bring the IS dwelling units up to a decent, safe, and sanitary condition for
5150,000.00, without any additional charges (i.e. Profit and Overhead net shown in MOVERS'
estimate). 1 agree to allow them to proceed with the rehabilitation of the units.

WHEREAS, on October 10, 2003, the Administration issued a Request for Proposals seeking a
new project sponsor to design and operate a supportive housing program targeting low income
persons living with AIDS; and
WHEREAS, at the Special City Commission Meeting of June 24, 2003, the City Commission
adopted Resolution No. 03-709 allocating Year 2003-2004 HOPWA Program funds to specified
agencies, including $1,500,000 to the City's Department of Community Development for the
Emergency Program;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The transfer of Fiscal Year 2003-2004 HOPWA funds, in the total amount of $250,000,
from the City's Department of Community Development/Emergency Program and the allocation of said
funds, in the amount of $100,000, to MOVERS, Inc. for the operation and maintenance of the Life
Quest Facilities located at 1301 Northeast 111th Street, 11115 Northeast 13th Avenue, 1075
Northeast 149th Street, 1095-97 Northeast 149th Street and 14950-52 Northeast llth Avenue, Miami,
Florida, for the period beginning January 1, 2004 through September 30, 2004, to be occupied by low
income persons with AIDS referred by the City, is authorized, and the amount of $150,000, for
construction rehabilitation of Life Quest, is authorized, contingent upon approval from the City's
Housing and Commercial Loan Committee.
Section 3. The transfer of the Life Quest facilities by Lock Towns to MOVERS, Inc., is authorized,
subject to parcel reverter provisions, as deemed appropriate by the City Manager and the City
Attorney.
Section 4. The City Manager is authorized{1} to execute a HOPWA Agreement, in substantially the
attached form, with Movers, Inc., for said purposes.
Section 5. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10)
calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it
shalt become effective immediately upon override of the veto by the City Commission.

Miami -Dade County ("Miami -Dade"); and
WHEREAS, HUD has advised that the Program Year 2003-2004
funding to implement the HOPWA Program will be $10,617,000;- and
WHEREAS, unallocated HOPWA funds, in the amount of
$5,200,000 from Program Year 2002-2003, are available for
distribution; and
WHEREAS, the City retained the services of Apple Tree
Perspectives, Inc. to conduct a needs assessment and planning
process, with the participation of the Miami -Dade HIV/AIDS
Partnership, through its Housing Committee; and
WHEREAS, the needs assessment and planning process was
designed ,to assist the City and the Partnership by:
(1) identifying the housing needs and preferences of persons
living with HIV/AIDS in Miami -Dade and (2) determining the best
use of available resources, including HOPWA funds, to address
such housing needs; and
WHEREAS, the needs assessment and planning process
ncorporated a review of: (1) findings of `consumer and prc rider
surveys and focus groups; (2) Miami-Dade's current housing
continuum of care for persons with AIDS, including funding
sources, with comparison of continuum of care leveraging
practices to other communities; -(3) demographic profile of
current HOPWA clients ("Attachments C," attached and -

incorporated); (4) allocation practices of other HOPWA grantee
communities which receive substantial HOPWA dollars; and
(5) anticipated direction of HUD funding policies for the HOPWA
program; and
WHEREAS, on April 14, 2003, the Miami -Dade HIV/AIDS
Partnership accepted the funding recommendations of its Housing
Committee for the allocation of HOPWA funds for Fiscal Year
2003-2004, which incorporated a distinction between City
responsibilities from those that would be contracted out to
community -based agencies through a competitive process and
directed these recommendations to the City for consideration
("Attachment A" and "Attachment B," attached and incorporated);
and
WHEREAS, the Administration held three public comment
meetings on the proposed funding recommendations; and
WHEREAS, on April 28, 2003, the Administration issued a
Request for Proposals to solicit proposals for services and
projects in accordance with the funding recommendations and
subsequently held two application workshops;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The allocation of Fiscal Year,. 2003-2004
HOPWA Program funds, in the amount of $10,617,000, and Fiscal
Year 2002-2003 unallocated HOPWA Program funds, in the amount of
$5,200,000, for a total of $15,817,000, is approved, to the
agencies specified in "Attachment A," attached and incorporated,
to provide housing assistance and related services to low-income
individuals living with AIDS.
Section 3.
The City Manager is authorized??-` to execute
individual HOPWA Program Agreements ("Agreements"),
in
substantially the attached form, with each agency for long-term
assistance services, with an option to renew the Agreements for
one additional year at a renegotiated fee, at the City Manager's
discretion.
The herein authorization is further subject to. compliance with
all requirements that may be imposed by the City Attorney,
including but nct limited to those prescribed• by applicable City
Charter and Code provisions.

Section 9. This Resolution shall become effeczive
immediately upon its adoption and signature of the Mayon.;
