HomeMy WebLinkAboutExhibit 1-SUBMEMORANDUM OF UNDERSTANDING AMENDING ARTICLE 39 OF THE COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY OF MIAMI, FLORIDA AND THE FRATERNAL ORDER OF POLICE, WALTER E. HEADLEY, JR., MIAMI LODGE NO. 20 The City of Miami, Florida (hereinafter "City") and the Fraternal Order of Police, Walter E. Headley, Jr., Miami Lodge No. 20 (hereinafter "FOP") hereby stipulate and agree to amend Article 39 of the Collective Bargaining Agreement between the parties as follows: A. Section 39.1.B.1 shall be amended as follows: Upon election of participation in the DROP, through forms and procedures as prescribed by the Pension Board of Trustees, a bargaining unit member's creditable service, accrued benefits, and compensation calculation shall be frozen and shall be based on the single highest year preceding participation in the DROP, as the basis of calculating the DROP payment. Upon commencement of participation in the DROP, the bargaining unit member contribution and the City contribution to the Retirement System for that bargaining unit member shall cease as the bargaining unit member will be earning no further service credit. The bargaining unit member shall not acquire additional pension credit for the purpose of the pension plan but may continue City employment for up to a maximum of forty eight (48) eighty-four (84) months. B. Section 39.1.C.1 shall be amended as follows: The maximum period of participation in the DROP shall be forty-- eight (48) eighty-four (84) months. Once the maximum participation has been achieved, the bargaining unit member must terminate employment. Li] Q . O 0 ontyi I= C.) 1.4 CO co GO CIL I --- The amendments set forth above shall become effective upon ratification of this MOU by the parties and shall apply to all police officers that are members of the FIPO Plan, even if they have already entered the DROP. This amendment does not apply to individuals who have separated from City employment.
