The following minor changes are recommended to be made to the ordinance prior to the
second reading.
• replace "sights" with "sites" throughout
• replace "Permeates" with "Permittees" throughout
• 62-603(g) - after "which shows that the Applicant", add "or its Affiliate" (with respect to
minimum number of leases and revenues)
• 62-603 (j) — delete "any existing" (in front of "notice of violation"); add "as of the effective date
of this ordinance" at end of sentence regarding notice of violation and open code enforcement
matters.
• 62-603 (j) - delete "due for each application" after provision regarding paying three times the
Qualification Fee
• 62-606 (f) — after "fifteen percent (15%) of the Mural Face," add "not including logos,
trademarks, or service marks of the commercial sponsor."
• 62-608 — delete "A Permittee shall have thirty (30) days from the issuance a Mural Permit to
install a Mural at the approved site. Should the Permittee fail to install the permitted Mural
within such thirty (30) day period, the City Zoning Administrator shall rescind the Mural
Permit."
• 62-609 (a)(iii) — delete "The City Zoning Administrator shall not approve a change to the Mural
Face if such approval results in an increase of any of the linear dimensions of the previously
permitted Mural Face."
• 62-609(b)(i)(x) — delete " that were not reasonably foreseeable to the Permittee when it
submitted its permit application or"
• 62-613 — change existing text "the City Zoning Administrator shall rescind the Mural Permit" to
"the City Zoning Administrator shall initiate proceedings to rescind the Mural Permit under
Section 62-612"
• 62-615 — add "the City will invoice all Permittees, and all Permittees" before "shall be required
to pay a renewal fee for each renewal permit ..."
• 62-615 - after "In the event any renewal fee is not paid," add " by the payment deadline indicated
on the invoice, the City shall notify the Permittee in writing, and the Permittee shall have ten
days to pay the renewal fee with interest accruing at the rate of eighteen percent (18%) per
annum until paid. If the Permittee fails to pay the invoice plus accrued interest within 10 days
after receipt of notice."
