AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER
54/ARTICLE V/SECTION 54-190 OF THE CODE OF THE CITY OF MIAMI,
FLORIDA, AS AMENDED, ENTITLED "STREETS AND SIDEWALKS/BASE
BUILDING LINES/NONSTANDARD STREET WIDTHS," TO MODIFY THE WIDTH
OF SOUTHWEST AND NORTHWEST NORTH RIVER DRIVE BETWEEN
SOUTHWEST 3RD STREET AND NORTHWEST 5TH STREET, MIAMI, FLORIDA;
CONTAINING A REPEALER PROVISION AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, Article V of Chapter 54 of the Code of the City of Miami, Florida, as amended ("City
Code"), establishes base building line locations for all public streets within the City of Miami; and
WHEREAS, Southwest and Northwest North River Drive between Southwest 3rd Street and
Northwest 5th Street, Miami, Florida, was originally dedicated as a 50 foot wide roadway; and
WHEREAS, the zoned street width of this roadway was increased to 60 feet wide but the private
properties adjacent to Southwest and Northwest North River Drive, Miami, Florida, have not been
dedicated or developed to the 60 foot width; and
WHEREAS, numerous impediments exist to widening the roadway to the full 60 feet in width
including the historic "East Coast Fisheries" building and the Southwest 1st Street bridge support
columns that conform to the original 50 foot wide roadway; and
WHEREAS, the Miami River Greenway Concept Plan ("Greenway") and the Capital Improvement
construction project for North River Drive have developed the Greenway within the existing 50 foot
wide dedicated portion of the right of way; and
WHEREAS, the reduction in the zoned right of way width of the roadway will not affect the
continuity of the Greenway or public access to the Riverwalk and waterfront; and
WHEREAS, the Miami River Commission has evaluated the effect of the reduction of the zoned
street width of this roadway with respect to the preservation and function of the Miami River corridor
and has no substantial objections;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. Chapter 54/Article V/Section 54-190 of the City Code, entitled "Streets and
Sidewalks/Base Building Lines/Nonstandard Street Widths," is amended in the following particulars:

*Exception -At the southwesterly intersection of N.W. North River Drive and N.W. 4th Street, the new
street lines through lot "B" as shown on Rand's Subdivision of block 71N and block 72N, according to
the plat thereof as recorded in plat book 2, at page 99 of the public records of Dade County, Florida,
shall be joined by a tangential curve having a radius of 400 50 feet.

Section 3. All Ordinances or parts of Ordinances that are inconsistent or in conflict with the
provisions of this Ordinance are repealed.
Section 4. If any Section, part of a section, paragraph, clause, phrase or word of this Ordinance is
declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective 30 days after final reading and adoption thereof.

{2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within (10)

effective immediately upon override of the veto by the City Commission.
