Subject: Lease Agreement with West Flagler Park Baptist Church of Miami, Inc., a Florida non-profit
corporation for the use of a vacant lot located at the north side of 5911 W. Flagler Street.
Purpose of Item:
A Resolution of the Miami City Commission with attachments authorizing the City Manager to
execute a Lease Agreement (the "Lease") between the City of Miami ("Lessee") and West Flagler
Park Baptist Church of Miami, Inc, a Florida non-profit corporation ("Lessor"), in substantially the
attached form, for the use of a vacant lot consisting of approximately 13,650 square feet located at the
rear (northern) portion of 5911 W. Flagler Street, Miami, Florida. The lease is for a term of two (2)
years that shall commence when the Lessee physically occupies the Premises. The lease term has an
option to extend for two (2) additional one-year terms. Rent for the first year shall be at a rate of
$1,500.00 per month plus water, sewer and electric, with rent to be increased annually by three
percent (3%). Funds will be allocated from Capital Improvement Project B-60452B,
32000-181000--670000-0000-00000; with other terms and conditions as more particularly set forth in
the Lease Agreement.

Subject: Lease Agreement with West Flagler Park Baptist Church of Miami, Inc., a Florida non-profit
corporation for the use of a vacant lot located at the north side of 5911 W. Flagler Street.
Background Information:
This item seeks City Commission approval to lease vacant land from West Flagler Park Baptist Church
of Miami, Inc., a Florida non-profit corporation. The vacant land is located at the rear of 5911 W.
Flagler Street, Miami, Florida, and will be used for occupancy by the City's Fire Department (Station
11).
Fire Station 11 currently occupies the city -owned building located on 5920 W. Flagler Street. The Fire
Department is undertaking the planning stages to demolish the existing structure and to build a new
facility in its place. The project will therefore require its firefighter and fire -rescue staff to be relocated
off -site during the construction.
After a lengthy property search, the City determined that the centrally located church site, which is
situated directly across Flagler Street from the existing Fire Station 11 building, is the best location for
the temporary fire station, especially since there were virtually no other appropriate sites in this heavily
populated and commercialized area. The City negotiated a lease with the Lessor for a term of two (2)
years, with two options to renew for additional one-year terms. The church site is ideally situated as it is
in the longitudinal and latitudinal center of the call area of Fire Station 11. The rental charge for use of
5911 W. Flagler Street will be $1,500/month or $18,000/annually. The Fire Department will pay for its
own utilities. The lease calls for annual increases of three percent (3%).
A neighborhood meeting to discuss the use of the lot was held on March 5, 2008. The plans for the use
of the property includes installing a 6' shadow-box fence along the perimeter with adjacent neighbors;
and cherry hedges in the front (street -side) of the property. Emergency fire vehicles will turn on sirens
only after arriving on Flagler Street as a noise prevention measure.
The City shall have the right at any time after the first 12 months to terminate this agreement upon
providing at least 60 days advance written notice.
