HomeMy WebLinkAboutR-08-0182City of Miami Legislation Resolution: R-08-0182 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 08-00332 Final Action Date: 4/10/2008 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE AGREEMENT ("LEASE"), BETWEEN THE CITY OF MIAMI ("LESSEE") AND WEST FLAGLER PARK BAPTIST CHURCH, A FLORIDA NON-PROFIT CORPORATION, IN SUBSTANTIALLY THE ATTACHED FORM, FOR THE USE OF A VACANT LOT CONSISTING OF APPROXIMATELY 13,650 SQUARE FEET LOCATED AT THE REAR NORTHERN PORTION OF 5911 WEST FLAGLER STREET, MIAMI, FLORIDA, WITH ATERM OF TWO (2) YEARS THAT SHALL COMMENCE WHEN THE LESSEE PHYSICALLY OCCUPIES THE PREMISES, WITH THE OPTION TO EXTEND FOR TWO (2) ADDITIONAL ONE-YEAR TERMS; PROVIDING FOR RENT FOR THE FIRST YEAR AT A RATE OF $1,500, PER MONTH PLUS UTILITIES, WITH RENT TO BE INCREASED BY THREE PERCENT (3%) ANNUALLY, WITH OTHER TERMS AND CONDITIONS AS MORE PARTICULARLY SET FORTH IN THE LEASE; ALLOCATING FUNDS FROM CAPITAL IMPROVEMENT PROJECT B-60452B 32000-181000-670000-0000-00000. WHEREAS, City of Miami ("City") Fire Station 11 generally occupies a City -owned building located at 5920 West Flagler Street, Miami, Florida; and WHEREAS, the City Fire Department will be constructing a new building in place of the existing structure which shall require the temporary relocation of the firefighters and fire -rescue staff during construction; and WHEREAS, demolition of the old building and construction of the new building is expected to take approximately two years; and WHEREAS, the City has negotiated with the West Flagler Baptist Church, Inc. for the temporary use during the construction of the current Fire Station 11 site of the church's vacant lot located in the rear, northern portion of its property located at 5911 West Flagler Street, Miami, Florida; and WHEREAS, the City has expressed its interest in leasing a vacant lot approximately 13,650 square feet on a property located at 5911 West Flagler Street, Miami, Florida, to temporarily house Fire Station 11; and WHEREAS, the City has negotiated with the owners of said vacant lot, West Flagler Park Baptist Church, Inc., a lease for a two-year term, with two additional one-year options, and with the City paying an initial rent at a rate of $1,500, per month or $18,000, annually; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by City of Miami Page 1 of 2 File Id: 08-00332 (Version: 11 Printed On: 5/1/2017 File Number: 08-00332 Enactment Number: R-08-0182 reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute a Lease Agreement ("Lease"), between the City ("Lessee") and West Flagler Park Baptist Church of Miami, Inc, a Florida non-profit corporation, in substantially the attached form, for the use of a vacant lot consisting of approximately 13,650 square feet located at the rear (northern) portion of 5911 West Flagler Street, Miami, Florida, with a term of two (2) years that shall commence when the Lessee physically occupies the premises, with the option to extend for two (2) additional one-year terms, that provides for rent for the first year at a rate of $1,500, per month plus utilities, with rent to be increased by three percent (3%) annually, with other terms and conditions as more particularly set forth in the Lease, with funds allocated from Capital Improvement Project B-60452B 32000-181000-670000-0000-00000. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
