A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
GRANTING THE APPEAL, REVERSING THE DECISION OF THE ZONING BOARD
AND THEREBY GRANTING A SPECIAL EXCEPTION AS LISTED IN ORDINANCE
NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI,
ARTICLE 4, SECTION 401, UNDER CONDITIONAL PRINCIPAL USES (3) OF R-1
SINGLE-FAMILY RESIDENTIAL, TO ALLOW PLACES OF WORSHIP, FOR THE
PROPERTY LOCATED AT APPROXIMATELY 3570 MAIN HIGHWAY, MIAMI,
FLORIDA, PURSUANT TO PLANS ON FILE AND SUBJECT FURTHER TO A TIME
LIMITATION OF TWELVE (12) MONTHS IN WHICH A BUILDING PERMIT MUST BE
OBTAINED.
WHEREAS, the Miami Zoning Board at its meeting on January 28, 2008, Item No. 1, adopted
Resolution No. ZB 08-006 by a vote of four to three (4-3), to DENY the Special Exception as
hereinafter set forth; and
WHEREAS, the City Commission approves the Special Exception as hereinafter set forth,
pursuant to Zoning Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami,
Florida; and
WHEREAS, the City Commission after careful consideration of this matter, and notwithstanding
the decision of the Zoning Board, finds the application for the Special Exception meet the applicable
requirements of Zoning Ordinance No. 11000, as amended, and deems it advisable and in the best
interest of the general welfare of the City of Miami and its inhabitants to reverse the decision of the
Zoning Board and grant the Special Exception as hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The decision of the Zoning Board to deny the Special Exception as listed in Ordinance
No. 11000, as amended, the Zoning Ordinance of the City of Miami, Article 4, Section 401, under
Conditional Principal Uses (3) of R-1 Single -Family Residential, to allow a place of worship, for the
property located at approximately 3570 Main Highway, Miami, Florida, legally described in the
attached "Exhibit A," pursuant to plans on file and subject to a time limitation of twelve (12) months in
which a building permit must be obtained, is reversed, and the Special Exception granted.
Section 3. The findings of fact set forth below are made with respect to the subject property:
a. Pursuant to Section 1305.2 of the Zoning Ordinance, the specific site plan aspects of the
project that have been found by the City Commission (based upon facts and reports prepared or

These findings have been made by the City Commission to approve this project with conditions,
which include:
1) no parking by visitors or guests of the applicant will be allowed, except parking in the nine
(9) spaces on the property;

2) the applicant must assure that an individual is assigned to monitor parking anytime nine
(9) or more visitors are on the premises;
3) the City Commission will receive a report in one (1) year from staff as to compliance by the
applicant with the special exception conditions;
4) a failure to follow these conditions may be deemed a violation of the special exception.
Section 4. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor. {1}
Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
