HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 08-00290 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF A SOLE SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES AND APPROVING THE PROCUREMENT OF REPAIR SERVICES OF MSA THERMAL IMAGING CAMERAS FOR THE DEPARTMENT OF FIRE -RESCUE, FROM MINE SAFETY APPLIANCES COMPANY, THE SOLE SOURCE PROVIDER, ON A CONTRACT BASIS FOR A ONE-YEAR PERIOD, WITH THE OPTION TO EXTEND FOR TWO (2) ADDITIONAL ONE-YEAR PERIODS, AT A FIXED AND FIRM LABOR RATE OF $100, PER HOUR, FOR THE THREE (3) YEAR PERIOD, IF OPTIONS ARE EXERCISED, AND PARTS CALCULATED USING MANUFACTURER'S CURRENT LIST PRICING; ALLOCATING FUNDS FROM THE VARIOUS SOURCES, SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED. WHEREAS, the Department of Fire -Rescue ("Fire -Rescue") requires repairs of its "MSA" Thermal Imaging Cameras; and WHEREAS, Mine Safety Appliances Company, the manufacturer of these thermal imaging cameras, require their cameras to be repaired at their factory repair center in Cranberry Township, Pennsylvania; and WHEREAS, the labor rate will be at a fixed and firm labor rate of $100, per hour for the three (3) year period of the contract, if options are exercised, and parts will be calculated using current Manufacturer's list pricing; and WHEREAS, funds will be allocated from the various sources of funds as may become available and subject to budgetary approval at time of need; and WHEREAS, the Chief Procurement Officer has found that Mine Safety Appliances Company, is the sole source for the required repair of the MSA Thermal Imaging Cameras; and WHEREAS, the finding of the Chief Procurement Officer has been approved and adopted as the finding of the City Manager; and WHEREAS, the City Manager and the Director of Fire -Rescue recommend that the requirements for competitive formal sealed bids be waived and the procurement of the aforementioned service as specified be approved; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, City of Miami Page 1 of 2 Printed On: 3/18/2008 File Number: 08-00290 FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's finding of a sole source is ratified, approved and confirmed, the requirements for competitive sealed bidding procedures are waived, and the procurement of repair services of the MSA Thermal Imaging Cameras for the Department of Fire -Rescue, from Mine Safety Appliances Company, the sole source provider of this service, is approved, on a contract basis for a one-year period, with the option to extend for two (2) additional one-year periods, at a fixed and firm labor rate of $100, per hour for the three (3) year period, if options are exercised, and parts to be calculated using current Manufacturer's list pricing, with funds allocated from the various sources, subject to the availability of funds and budgetary approval at the time of need. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} APPROVED AS TO FORM AND CORRECTNESS: JULIE O. BRUr— CITY ATTORNEY \' Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
