A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO SUBMIT AN APPLICATION FOR GRANT
FUNDING TO THE FLORIDA INLAND NAVIGATION DISTRICT ("FIND")
WATERWAYS ASSISTANCE PROGRAM, IN SUBSTANTIALLY THE ATTACHED
FORM, IN AN AMOUNT NOT TO EXCEED $25,000, FOR THE LIGHTSTATION
CHANNEL MARKER REPLACEMENT PROJECT, WITH MATCHING FUNDS, IN
THE AMOUNT OF $12,500, TO BE PROVIDED EACH BY THE BISCAYNE BAY
YACHT CLUB AND THE CORAL REEF YACHT CLUB; AUTHORIZING THE CITY
MANAGER TO EXECUTE ANY OTHER NECESSARY DOCUMENTS FOR THE
SUBMISSION OF SAID GRANT APPLICATION FOR FISCAL YEAR 2008-2009.
WHEREAS, the City of Miami ("City) wishes to replace the current substandard channel marker
with a substantially stronger light station ("Project"); and
WHEREAS, the total cost of the Project is estimated not to exceed $25,000; and
WHEREAS, the City entered into an easement agreement with the Biscayne Bay Yacht Club,
dated May 31, 2006, and an easement with the Coral Reef Yacht Club, dated May 5, 2006, as
amended on June 19, 2007, which easements (collectively the "Easements") required that the
Biscayne Bay Yacht Club and the Coral Reef Yacht Club (collectively "Clubs") contribute up to fifty
percent (50%) of the cost of a lighted navigation marker at the end of the Seaplane Channel; and
WHEREAS, the City has requested the Clubs install a four piling Tight station in lieu of a single
piling lighted navigation marker due to its greater stability; and
WHEREAS, to assist in offsetting the cost increase for the four piling light station, the City wishes
to apply for a Florida Inland Navigation District (FIND") in the amount of $12,500 or fifty percent (50%)
of the total Project cost; and
WHEREAS, matching funds in the amount of $12,500 or (50%) of the total cost shall be provided
by the Clubs;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized {1} to submit an application for grant funding to FIND
Waterways Assistance Program, in substantially the attached form, in an amount not to exceed
$25,000, for the Project, and to execute any other necessary documents for the submission of said
grant application for Fiscal Year 2008-2009.

Section 3. The City of Miami further certifies to FIND the following matters:
The City accepts the terms and conditions set forth in FIND Rule 66B-2 F.A.C., which outlines the
Waterways Assistance Program and which will be a part of the Project Agreement for any assistance
under this proposal;
The City is in complete accord with the proposal and agrees to carry out the program in the manner
described in the proposal and any plan and specifications attached thereto; unless prior approval for
any change has need received from FIND;
The City has the ability and intention to finance its share of the cost of the Project and that the Project
will be operated and maintained at the expense of the City for public use;
The City will not unlawfully discriminate against any person on basis of race, color or national origin in
the use of any property or facility acquired or developed pursuant to this proposal, and shall comply
with the terms and intent of the Title VI of the Civil rights Act of 1964, P.L. 88-352 (1964) and design
and construct all facilities to comply fully with statutes relating to accessibility by handicapped persons
as well as other federal, state and local laws, rules and requirements;
The City agrees to maintain adequate financial records for the proposed Project to substantiate claims
for reimbursements; and
The City will make available to FIND, if requested, a post -audit of expenses incurred on the Project
prior to, or in conjunction with, request for the final ten percent (10%) of the funding agreed to by
FIND.
Section 4. The matching funds, in an amount not to exceed $12,500, shall be provided in equal
amount from the Clubs in accordance with the Easements.
Section 5 This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
