HomeMy WebLinkAboutR-08-0132City of Miami Legislation Resolution: R-08-0132 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 08-00241 Final Action Date: 3/13/2008 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE MODIFICATION #1 TO THE GRANT AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, IN ORDER TO EXTEND THE URBAN AREA SECURITY INITIATIVE ("UASI") PROGRAM III (FISCAL YEAR 2006) ORIGINAL AGREEMENT, TO JUNE 30, 2009, PURSUANT TO RESOLUTION NO. 06-0668, ADOPTED NOVEMBER 9, 2006; FURTHER AUTHORIZING THE CITY MANAGER TO EXTEND SAID GRANT AWARD AND TO EXECUTE ANY OTHER RELATED AMENDMENTS OR EXTENSIONS ON ALL MATTERS EXCEPT THOSE DEALING WITH FUNDING CHANGES, IN CONNECTION WITH THE DEVELOPMENT AND SUPPORT OF THE UASI PROJECT ADMINISTERED BY THE CITY OF MIAMI DEPARTMENT OF FIRE -RESCUE, AS AN UASI SPONSORING AGENCY, CONTINGENT UPON THE FUNDING OF THE PROJECT BEING SECURED IN THE FORM OF GRANTS, FROM THE OFFICE OF GRANTS AND TRAINING THROUGH THE STATE OF FLORIDA, DIVISION OF EMERGENCY MANAGEMENT. WHEREAS, the United States Department of Homeland Security, Office of Grants and Training, is authorized by the Emergency Wartime Supplemental Appropriations Act 2003, to provide funds to states for subsequent distribution to selected urban areas, and to assist them in building an enhanced and sustainable capacity to prevent, respond to, and recover from threats or acts of terrorism; and WHEREAS, The Office of Department Preparedness, through the State of Florida Division of Emergency Management ("DEM"), awarded a sub grant, Urban Areas Security Initiative ("UASI") Grant Project III (Fiscal Year 2006), to the City of Miami ("City") and its contiguous county, Miami -Dade County, Monroe County, City of Hialeah and the Florida Department of Health, in the amount of $15,980,000, for Fiscal Year 2006; and WHEREAS, the Agreement for said grant expired on January 31, 2008; and WHEREAS, DEM and the City, desire to reinstate the Agreement and to modify the Agreement by extending it to June 30, 2009; and WHEREAS, this Resolution seeks to authorize the City Manager to extend and modify said Agreement and any other amendments or extension on all matters except dealing with funding changes; and WHEREAS, pursuant to grant stipulations, said funds will be used by the Department of Fire -Rescue to address the unique equipment, training, planning, exercise and operational needs of the City and Miami -Dade County, Monroe County, City of Hialeah, and the Florida Department of Health and to assist the City in building an enhanced and sustainable capacity to prevent, respond to, and recover from threats or acts of terrorism; and City of Miami Page 1 of 2 File Id: 08-00241 (Version: 1) Printed On: 4/28/2017 File Number: 08-00241 Enactment Number: R-08-0132 WHEREAS, it is now appropriate for the City Manager to accept said grant and to establish a special revenue fund for the appropriation of said grant award; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1 } to execute Modification #1 to the Grant Agreement, in substantially the attached form, in order to extend the UASI Program II (Fiscal Year 2006) Original Agreement to June 30, 2009, pursuant to Resolution No. 06-0668, adopted November 9, 2006. Section 3. The City Manager is further authorized{1} to extend said grant award and to execute any other related amendments or extensions on all matters except those dealing with funding changes in connection with development and support of the UASI project administered by the City Department of Fire -Rescue, as an UASI sponsoring agency, contingent upon funding of the project being secured in the form of grants from the Office of Grants and Training through DEM. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
