Background of Item: The Florida Department of Transportation has jurisdiction over State Road 5 ("SR- 5")/Biscayne Boulevard from NE 29 Street to NE 30 Street, which is located within the limits of the City of Miami. OZPC NO 1 2900 BISCAYNE BLVD, LLC, pursuant to Permit #2023-L-690-00010, has drafted design plans for beautification improvements on SR- 5/ Biscayne Boulevard from NE 29 Street to NE 30 Street, the limits of which are described in the attached Exhibit "A". The Developer will install landscape, irrigation and pavers in accordance with the design plans for Permit #2023-L-690-00010, as approved by the Department. The City is aware this Maintenance Memorandum of Agreement, which is attached and incorporated as Exhibit "A", will supplement all maintenance requirements between the Department and the City for all previously executed permits and agreements. The City has made the Developer responsible for the operation, maintenance, and liability of the improvements via the execution of a non-standard improvement covenant running with the land. WHEREAS, the Florida Department of Transportation ("Department") has jurisdiction over State Road 5 ("SR-5")/Biscayne Boulevard from NE 29 Street to NE 30 Street, which is located within the limits of the City of Miami ("City"); and WHEREAS, OZPC NO 1 2900 BISCAYNE BLVD, LLC ("Developer"), pursuant to Permit #2023-L-690-00010, has drafted design plans for beautification improvements on SR- 5/ Biscayne Boulevard from NE 29 Street to NE 30 Street, the limits of which are described in the attached Exhibit "A" ("Project Limits"); and WHEREAS, the Developer will install landscape, irrigation and pavers in accordance with the design plans for Permit #2023-L-690-00010 ("Project"), as approved by the Department; and WHEREAS, the City is aware this Maintenance Memorandum of Agreement ("MMOA"), which is attached and incorporated as Exhibit "A", will supplement all maintenance requirements between the Department and the City for all previously executed permits and agreements; and WHEREAS, the City has made the Developer responsible for the operation, maintenance, and liability of the improvements via the execution of a non-standard improvement covenant running with the land; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to execute the landscape, irrigation and pavers MMOA, in substantially the attached form, with the Department, to facilitate the installation and maintenance of the improvements on SR- 5/ Biscayne Boulevard from NE 29 Street to NE 30 Street. 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to those prescribed by applicable City Charter and City Code provisions. Section 3. This Resolution shall become effective immediately upon its adoption.
