HomeMy WebLinkAboutPre-Legislation2City of Miami Legislation Resolution: R-07-0133 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 07-00306 Final Action Date: 3/8/2007 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), MODIFYING CONDITION/ RESTRICTION NO. 5 OF THE CORRECTIVE QUIT CLAIM DEED, DATED JULY 5, 2006, FROM THE CITY OF MIAMI TO MIAMI DREAM HOMES INVESTMENT GROUP, INC. TO PROVIDE THAT CONSTRUCTION ON THE PROPERTY LISTED IN EXHIBIT "A," ATTACHED AND INCORPORATED, OF ONE SINGLE FAMILY HOME MUST COMMENCE NO LATER THAN JULY 1, 2007; STATING THE INTENTION OF THE CITY COMMISSION RELATED TO THE CONVEYANCE OF TITLE TO THE PROPERTIES LISTED ON EXHIBIT "A"; CONFIRMING THE REVERSION TO THE CITY OF MIAMI OF TITLE TO ONE VACANT PARCEL OF LAND LOCATED AT 1477 NORTHWEST 60 STREET, MIAMI FLORIDA, LISTED ON EXHIBIT "B," ATTACHED AND INCORPORATED; AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS FOR SAID PURPOSE. WHEREAS, pursuant to Resolution No. 05-0357, adopted May 26, 2005, the City Commission approved the conveyance, with title reverter conditions, of eleven parcels of City of Miami ("City") owned land directly to developers, for the construction of affordable housing for eligible low and moderate income persons; and WHEREAS, six (6) of the eleven parcels of City -owned land were conveyed to Miami Dream Homes Investment Group, Inc. (the "Properties") for the new construction of affordable single family homes; and WHEREAS, pursuant to Resolution No. 06-0329, adopted May 25, 2006, the City Commission approved the development as a new construction multi- family rental project, consisting of seven (7) units for low income persons, of the parcel of land located at 1525 Northwest 60 Street, Miami, Florida; and WHEREAS, the Properties were conveyed to Miami Dream Homes Investment Group, Inc. ("Miami Dream Homes") by Quit Claim Deed dated September 27, 2005 and Corrective Quit Claim Deed dated July 5, 2006; and WHEREAS, due to the delay in obtaining permits from the Department of Water and Sewer and the Department of Environmental Resource Management, Miami Dream Homes was unable to start construction as required by the quit claim deeds; and WHEREAS, the Administration recommends modifying the Corrective Quit Claim Deed to Miami Dream Homes to provide that construction on the Properties of one (1) single family home must commence no later July 1, 2007; and WHEREAS, the Administration also recommends confirming that title to the property located at 1477 Northwest 60 Street Miami, Florida, previously conveyed to Miami Dream Homes, has reverted to City of Miami Page 1 of 2 Printed On: 1/30/2008 File Number:' 07-00306 Enactment Number: R-07-0133 the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The modification of Condition/ Restriction No. 5 of the Corrective Quit Claim Deed dated July 5, 2006, from the City to Miami Dream Homes, to provide that construction of one (1) single family home on the property listed on Exhibit "A," attached and incorporated, must commence no later than July 1, 2007, is approved. Section 3. It is in the intention of the City Commission that title to the parcels described in Exhibit "A," attached and incorporated, except for the parcel located at 1477 Northwest 60 Street Miami, Florida, shall be deemed to have remained in Miami Dream Homes from the date of conveyance, and that the extension of time granted herein to commence construction shall be deemed to have been made on or before January 5, 2007. Section 4. The reversion of title to City of the parcel of land located at 1477 Northwest 60 Street Miami, Florida, listed in Exhibit "B," attached and incorporated, is confirmed. Section 5. The City Manager is authorized {1 } to execute all necessary documents for said purpose. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
