Purpose of Item: A Resolution of Miami City Commission updating use fees for use of office space at the Manuel Artime Theater and Community Center, located at 900 Southwest 1st Street and 970 Southwest 1st Street, Miami, Florida, respectively; further authorizing the City Manager to execute revocable license agreements, in a form acceptable to the City Attorney, with organizations for said purpose; further authorizing the City Manager to amend existing license agreements to modify the date for use fee adjustments to take place on October 1 of each year and provide for a 3% per year increase. Director_; City Manager If using or receiving capitr1 funds Grants 1} Purchasin Chief Pave 1 of 2 Subject: Resolution updating to Use Fees for licensees of office space at Manuel Artime Theater and Community Center. Background Information: In 2000, the City Commission adopted Resolution 00-25 which established license use fees for office space at Manuel Artime Theater and Community Center, located at 900 & 970 SW 1st Street, Miami. Use fees established by the Resolution were based on a market study of comparable properties in the East Little Havana area, which at the time was determined to be $8.50 and $7.75 per square foot for the 970 and 900 building, respectively. Resolution 00-25 further provided a 25% discount to non- profit organizations. Given the changes in the real estate market since 2000, the present Resolution revisits comparable market rates to arrive at a new square foot charge for office space licenses at Manuel Theater and Community Center. Comparable office spaces in the immediate vicinity of Manuel Artime buildings are being rented at a rate of $14.21 to $19.20 SF. After making adjustments to the comps, we have determined that an appropriate use fee for the 970 and 900 building is $15 and $13.50 per square foot, respectively. A twenty-five (25%) discount will continue to be provided to non-profit agencies that use space in either building. Existing licensees will continue to pay the use fees according to their respective licenses. New licenses commencing use in future years will pay a use fee based on the cumulated increases. Existing licensees will maintain their current rates except that 1) any expansion by existing Licensees will incur the rates set forth herein, but only with respect to the expanded portion of their office space and 2) the timing of increases will be changed so that they are uniform. In the interest of making use fee increases more simplified and uniform with respect to their timing, this Resolution authorizes the City Manager to amend existing Licenses to: (1) allow for one uniform October 1 annual increase, and (2) provide a straight three percent (3%) annual increase instead of increases based on the Consumer Price Index. Lastly, the Resolution reaffirms the City Manager's authority to continue to execute revocable license agreements for organizations using space at the above locations, when paying the rates set forth herein.
