Policy LU-1.1.1: Development orders authorizing new development or redevelopment
that results in an increase in the density or intensity of land use shall be contingent upon
the availability of public facilities and services that meet or exceed the minimum LOS
standards adopted in the CIE.
The land use amendment proposed by this application will not exceed or increase the
LOS (level of service) greater than it was, since this application is for the adaptive reuse
of the property which was a motel with restaurant.
Policy LU-1.1.7: Land development regulations and policies will allow for the provision
of adequate neighborhood shopping, recreation, day care, entertainment and other
neighborhood oriented support activities.
The land use amendment proposed will promote the adaptive reuse of a motel which use
is no longer permitted, for the introduction of retail, shopping, entertainment and
restaurants in an existing historic structure.
Objective LU-1.3: The City will continue to encourage commercial, office and industrial
development within existing commercial, office and industrial areas; increase utilization
and enhance the physical character and appearance of existing buildings; and concentrate
new commercial and industrial activity in areas where the capacity of existing public
facilities can meet or exceed the minimum levels of service (LOS) adopted in the Capital
Improvement Element (CIE).
The following policies provide for the City to financially assist owners to use existing
buildings for new uses, to promote the maintenance and restoration of buildings,
particularly in areas where the City's LOS is already in place. A wonderful example is
our site which is located on 73rd and Biscayne which the City's services are already in
place.
Objective LU-1.5: Land development regulations will protect the city's unique natural
and coastal resources, and its historic and cultural heritage.
An objective of the land use regulations is to promote the historic and cultural heritage of
the past. The proposed land use amendment will permit the adaptive use of a historic site
in order to revive the building and allow for others to share in its history. The land use
amendment will permit the introduction of new uses to the site.
LU-1.6.3: The City's Planning Department shall review all proposals to amend the City's
Zoning Ordinance and any other land development regulations, and shall report as to the

consistency between any proposed amendment and the Miami Comprehensive
Neighborhood Plan, to the Planning Advisory Board, the City's "local planning agency"
which will then forward its recommendation to the City Commission for approval and
adoption.
We feel that the City erred in its recommendation of denial for the land use amendment
because the requested land use amendment corrects an inconsistent land use designation
that the City adopted when it divided a single platted lot into two zoning designations. In
addition, the land use amendment is consistent with the Comp Plan because it is permits
for a single platted lot, to have the same uses throughout the single tract of land.
LU-1.6.4: Any proposal to amend the City's zoning ordinance that has been deemed to
require an amendment to the Future Land Use Plan Map by the Planning Department
shall require a concurrency review and a finding from the Planning Department that the
proposed amendment will not result in a LOS that falls below the adopted minimum
standards, and will not be in conflict with any element of the Miami Neighborhood
Comprehensive Plan.
The concurrency report that the Planning Board prepared and a copy of which is in your
back up material provides that the concurrency for this area is consistent with the Comp
Plan's minimum standards.
Goal LU2: Preserve and protect the heritage of the City of Miami through the
identification, evaluation, rehabilitation, adaptive reuse, restoration and public awareness
of Miami's historic, architectural and archeological resources.
Objective LU-2.4: Increase the number of historic structures that have been preserved,
rehabilitated or restored, according to the U.S. Secretary.
