Bayshore Drive PROJECT DESCRIPTION ANALYSIS Application for a Certificate of Appropriateness for the installation of a metal gate at the front property line after -the -fact. The building is a non-contributing property built in 1969. There is no tax photo available. The applicant received approval from the HEP Board in 1996 for a metal picket gate with masonry piers covered in keystone. The approved height of the masonry piers was five feet total, including the 3-inch pre -cast concrete cap. The center of the gate sloped up slightly in the middle. A copy of the approved gate is included in the Board packet. This Board did not approve the existing gate, composed of metal palm trees and vegetation. The guidelines for gates and fences state that the materials permitted are masonry or meta! picket if compatible with the architecture of the house. Fences and gates are not normally allowed on the front property lines at al!. Because the properties on North Bayshore Drive are set far back from the front yards, the Board has often approved the installation of gates on the front property lines so that the owners can fully use the yard space. In 1996 the Board approved a simple metal picket and masonry fence because it was compatible with the house. The Board has been consistent by approving metal picket gates and fences that are compatible with the buildings and other gates and fences in the district. The owner of this property has stated that the fence matches artwork installed on the house and garage and is therefore compatible. However, in researching the permit history, Staff was not able to find permits for the work done on the house and garage. The gate does not meet the criteria for gates in Morningside, which calls for plain metal pickets or masonry piers with pickets. Because the work performed on the house was done without permits, the owner must first obtain approval from the HEP Board. It is recommended that he return with a new application demonstrating all the work done on the property and the legality of the garage door which must meet the requirements of the City and County for new doors. RECOMMENDATION The Preservation Officer recommends that the application for a Certificate of Appropriateness be approved, with the following conditions, because the proposed work is consistent with the historic and architectural character of the historic district in terms of size, scale, design and materials and complies with the Secretary of the Interior's "Standards for Rehabilitation." 1. The current gate shall be replaced with the metal picket gate approved by the Board in 1996. The owner shall return to the HEP Board by next month for approval of the installation of the artwork on the property. Item #4 November 6, 2007
