HomeMy WebLinkAboutAppeal UpdateC KGROUN 7 MORNINGSIDF GUIDELINES HEP BOARD RULING 5725 North Ba shore Drive This application for the approval of a .new metal gate came to the Historic and Environmental Preservation Board on November 6, 2007, after it was installed without a permit. The gate that was installed is comprised of a pair of palm trees and foliage with a sunburst background that reaches a height of 8' 10" The original application, which had been approved by the ..HEP .Board in 1996 was for a simple metal picket gate with masonry piers, totaling five feet in height. The guidelines for Morningside state that permitted materials for walls/gates include masonry or simple metal picket. Additionally, Morningside guidelines state that fences, walls and gates are not allowed on the .front property lines at all. However, because the properties that are on South Bayshore Drive (waterfront property) are set so far back towards the water, the .H.EP Board has typically allowed exemptions to the guidelines for these homes. In other words, the originally approved gate was already an exemption to the guidelines. The application was scheduled to go to the Historic and Environmental Preservation Board on November 6, 2007. The application was approved, with the condition that the gate be replaced with the one originally approved by the hoard in 1996. The HEP Board did not approve the installed metal gate because the gate did not comply with the guidelines; the installation was done without a permit, and the HEP Board felt that it would set a dangerous precedent to start permitting exemptions based on "artistic merit," without express guidelines for what types of artistic gates should be allowed.
