Although the owner's arborist report claims that the tree did not suffer damage as a
result of the construction, according to a Public Works report after a visit on Aug 13,
the owner seems to have violated several sections of the Tree Protection Ordinance:
Sec. 8.1.7. Tree protection.
8.1.11. Tree protection during construction. Trees shall be protected during
construction through the use of protective barriers in accordance with the
landscape manual. Trees that are to remain shall be clearly identified with tags.
A protected area with a radius of ten (10) feet shall be maintained around trees to
remain in accordance with the landscape manual, unless a certified arborist
otherwise determines in writing that a smaller or larger protected area is acceptable
for each tree, or an alternative tree protection method is recommended.
During demolition and/or development, including installation of irrigation systems or
any other underground installations, protective barriers shall be placed around each
tree and shall remain in order to prevent the destruction or damaging of roots,
stems or crowns of such trees. The barriers shall remain in place and intact until
such time as approved landscape operations begin; however, barriers may be
removed temporarily to accommodate construction needs, provided that the manner
and purpose for such temporary removal will not harm the trees. The trees shall be

On August 13, P W Assistant Director Francis Mitchell
advised that Public Works Submitted Into the NNW

The applicant was also informed on 8/13/2007 that he was in violation of
the Tree Protection Ordinance (Sec 8.1.7) and the Code of
Ordinances (Sec.17-76, and 35-10), and would be fined by Code
Enforcement. He may also be liable for mitigation as the tree may have
been substantially damaged by the demolition of the previous structure
and the new construction activity. He was instructed to:
• Install a construction barrier fence with a 10 ft radius around the
trunk of the Live Oak to protect the it and roots
• Stop all root pruning
• Move all construction & commercial equipment off the roots of
the tree (see photo of pick up, bobcat and a trailer parked on
the trees root plate)
• Discontinue all construction activity
• Come in to Public Works to meet with Mr. Mitchell to redesign
the driveway configuration, approach, and sidewalk to allow the
tree to remain and minimize the detrimental impacts to the tree
and tree roots.
