HEP BOARD RULING
The developer oaf the property located at 2840
Shipping Avenue had received porn its to remove
several trees on the property so that a two story
duplex could be constructed.
After the building was completed, the developer
then applied for another tree removal permit for an
Oak tree in the middle of the property. The
developer wanted to remove the tree in order to put
in two driveways to the garages of the duplex.
The Department of Public Works denied the permit
because the tree was not in poor condition and a
driveway could be worked around it. Since the
developer wanted to put a wall between the two
driveways and not have a shared driveway for the
two units, the developer appealed this denial by
Public Works to the HEP Board.
The Coconut Grove Tree Watch filed an appeal,
but since the Department denied the permit, no
appeal was necessary.
The appeal was scheduled to go to the Historic and
Environmental Preservation Board on November 6,
2007.
The HEP Board denied the developer's appeal., after
finding that the proposed tree removal does not
comply with the criteria for tree removal set forth in
article 8.1 of the tree protection ordinance.
Additionally, the HEP Board stated that the
driveway should be worked around the tree and that
the tree should be protected from any further
damage due to construction.
