Subject: EXTENDING CONSTRUCTION COMMENCEMENT DATE — RHHED
Purpose of Item:
A RESOLUTION OF THE NIIAMI CITY COMMISSION, WITH ATTACHMENT(S), (1) GRANTING TO
RAFAEL HERNANDEZ HOUSING AND ECONOMIC DEVELOPMENT, CORP. ("RHHED"), AN
EXTENSION OF TIME, UNTIL APRIL 30, 2008, TO COMMENCE CONSTRUCTION ON THE
PROPERTIES LOCATED AT 98 N.W. 27TH, STREET, AND 3511 N.W. 1ST AVENUE, MIAMI,
FLORIDA, (THE "PROPERTIES") LEGALLY DESCRIBED IN EXHIBIT "A", ATTACHED AND
INCORPORATED; (2) AN EXTENSION OF TIME, UNTIL DECEMBER 31, 2008, TO COMPLETE
CONSTRUCTION ON SAID PROPERTIES, AND (3) TRANSFERRING THE PROPERTY
LOCATED AT 3431 N.W. 6th AVENUE, MIAMI, FLORIDA, LEGALLY DESCRIBED IN EXHIBIT "B,"
ATTACHED AND INCORPORATED, PREVIOUSLY CONVEYED TO RHHED, REVERTING SAID
PROPERTY BACK TO THE CITY OF MIAMI ("CITY"); STATING THE INTENTION OF THE CITY
COMMISSION RELATED TO THE CONVEYANCE OF TITLE TO THE PROPERTIES;
AUTHORIZING THE CITY MANAGER TO EXECUTE MODIFICATIONS TO THE DEED(S) THAT
CONVEYED THE PROPERTIES FROM THE CITY OF MIAMI TO RAFAEL HERNANDEZ
HOUSING AND ECONOMIC DEVELOPMENT, CORP., AND ALL NECESSARY OTHER

Background Information:
Pursuant to Resolution No. 05-0522, adopted September 8, 2005, the City Commission approved the
conveyance of three City owned vacant parcels located at 3511 N.W. 1st Avenue, 98 N.W. 27th
Street, and 3431 N.W. 6th Avenue, Miami, Florida, to RHHED, for the development of affordable
housing for eligible low and moderate income persons.
On April 20, 2006 the City Manger executed the Quit Claim Deeds transferring said properties to
RHHED.
The Quit Claim Deeds required construction to start on the properties by April 20, 2007.
RHHED has informed the City, that in June 2006 RHHED submitted the plans for the properties to
Building and Zoning and said plans, after delays due to requests for various covenants, have been
approved as of September 21, 2007.
RHHED gave notice to the City, in a letter dated March 3, 2007, that it was returning the property
located at 3431 N.W. 6th Avenue back to the City, due to its inability to develop said property
because the lot is not connected to water and sewer lines.
In October 2007 the final permits were issued and said agency can commence with the construction
on the properties.
The City Administration recommends (1) granting to RHHED an extension until April 30, 2008, to
commence construction on the properties located at 98 N.W. 27th Street, and 3511 N.W. 1st Avenue,
Miami, Florida; (2) granting to RHHED an extension until December 31, 2008, to Complete
construction on said Properties and, (3) transferring the property located at 3431 N.W. 6th Avenue,
Miami, Florida, legally described in Exhibit "B," attached and incorporated, previously conveyed to
RHHED, and reverting said property back to the City.
