A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), (1)
GRANTING TO RAFAEL HERNANDEZ HOUSING AND ECONOMIC
DEVELOPMENT, CORP. ("RHHED") AN EXTENSION OF TIME, UNTILAPRIL 30,
2008, TO COMMENCE CONSTRUCTION ON THE PROPERTIES LOCATED AT 98
NORTHWEST 27TH, STREET, AND 3511 NORTHWEST 1ST AVENUE, MIAMI,
FLORIDA (THE "PROPERTIES"), LEGALLY DESCRIBED IN EXHIBIT "A,"
ATTACHED AND INCORPORATED; (2) AN EXTENSION OF TIME, UNTIL
DECEMBER 31, 2008, TO COMPLETE CONSTRUCTION ON SAID PROPERTIES,
AND (3) REVERTING TITLE TO THE PROPERTY LOCATED AT 3431 NORTHWEST
6th AVENUE, MIAMI, FLORIDA, LEGALLY DESCRIBED IN EXHIBIT "B,"
ATTACHED AND INCORPORATED, PREVIOUSLY CONVEYED TO RHHED, BACK
TO THE CITY OF MIAMI ("CITY"); STATING THE INTENTION OF THE CITY
COMMISSION RELATED TO THE CONVEYANCE OF TITLE TO THE PROPERTIES
DESCRIBED IN EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO EXECUTE
MODIFICATIONS TO THE DEED(S) THAT CONVEYED THE PROPERTIES FROM
THE CITY TO RHHED, AND ALL NECESSARY OTHER DOCUMENTS, FOR SAID
PURPOSE.
WHEREAS, pursuant to Resolution No. 05-0522, adopted September 8, 2005, the City
Commission approved the conveyance of three City of Miami ("City") owned vacant parcels located at
3511 Northwest 1st Avenue, 98 Northwest 27th Street, and 3431 Northwest 6th Avenue, Miami,
Florida, to Rafael Hernandez Housing and Economic Development, Corp. ("RHHED"), for the
development of affordable housing for eligible low and moderate income persons; and
WHEREAS, on April 20, 2006, the City Manger executed the Quit Claim Deeds conveying said
properties to RHHED; and
WHEREAS, the Quit Claim Deeds required construction to start on the properties by April 20,
2007; and
WHEREAS, RHHED has informed the City that in June, 2006 RHHED submitted the plans for the
properties to the City's Building and Zoning Department and said plans, after delays due to requests
for various covenants, were approved as of September 21, 2007; and
WHEREAS, in October, 2007, the final permits were issued and said agency can commence
construction; and
WHEREAS, RHHED gave notice to the City, in a letter dated March 3, 2007, that it was returning
title to the property located at 3431 Northwest 6th Avenue, Miami, Florida, back to the City, due to its
inability to develop said property because the lot is not connected to water and sewer lines; and
WHEREAS, the City Administration recommends (1) granting to RHHED an extension until April

30, 2008, to commence construction on the properties located at 98 Northwest 27th Street, and 3511
Northwest 1st Avenue, Miami, Florida; (2) granting to RHHED an extension until December 31, 2008,
to complete construction on said properties; and (3) reverting title to the property located at 3431
Northwest 6th Avenue, Miami, Florida, legally described in Exhibit "B," attached and incorporated,
previously conveyed to RHHED, back to the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The Miami City Commission (1) grants to RHHED an extension of time until April 30,
2008, to commence construction on the properties specified in Exhibit "A," attached and incorporated;
(2) grants to RHHED an extension of time until December 31, 2008 to complete construction on said
properties specified in Exhibit "A," attached and incorporated; and (3) authorizes the reversion of title
to the property located at 3431 Northwest 6th Avenue, Miami, Florida, legally described in Exhibit "B,"
attached and incorporated, previously conveyed to RHHED, back to the City.
Section 3. It is the intention of the Miami City Commission that title to the properties described in
Exhibit "A" shall be deemed to have remained in RHHED from the date of conveyance.
Section 4. The City Manager is authorized{1} to execute any required modifications to the deed(s)
that conveyed the property from the City to RHHED, and all necessary other documents, for said
purpose.
Section 5. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
