A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
APPROVING A DEVELOPMENT AGREEMENT, PURSUANT TO CHAPTER 163,
FLORIDA STATUTES, BETWEEN FLORIDA GAMING CENTERS, INC. D/B/A
MIAMI JAI -ALAI, AND THE CITY OF MIAMI, RELATING TO THE DEVELOPMENT
OF THE APPLICATION OF A ±7.6 ACRE, MORE OR LESS, PARCEL OF LAND
ZONED C-2, "LIBERAL COMMERCIAL," LOCATED ON THE SOUTHWESTERN
INTERSECTION OF NORTHWEST 36TH STREET AND 37TH AVENUE AT 3500
NORTHWEST 37TH AVENUE, MIAMI, FLORIDA, FOR THE PURPOSE OF THE
DEVELOPMENT/REDEVELOPMENT OF A PARIMUTUEL FACILITY, WITH
ASSOCIATED GAMING, AND OTHER PERMITTED COMMERCIAL USES;
AUTHORIZING THE CITY MANAGER TO EXECUTE THE DEVELOPMENT
AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, FOR SAID
PURPOSE.
WHEREAS, Florida Gaming Centers, Inc. d/b/a Miami Jai -Alai, is the owner of certain real property
in the City of Miami ("City") consisting of a ±7.6 acre, more or less, parcel of land zoned C-2, "Liberal
Commercial," located on the southwestern intersection of Northwest 36th Street and 37th Avenue at
3500 Northwest 37th Avenue, Miami, Florida; and
WHEREAS, Florida Gaming Centers, Inc. d/b/a Miami Jai -Alai has requested approval of a
Development Agreement ("Agreement"), pursuant to Chapter 163 of the Florida Statutes to provide
that Florida Gaming Centers, Inc. d/b/a Miami Jai -Alai may develop its 7.6 acres of land, more or less,
according to the C-2 "Liberal Commercial" district regulations in effect as of the effective date of the
Agreement during the term of the Agreement; and
WHEREAS, the City Commission has reviewed the proposed Development Agreement and has
considered the testimony of all interested parties at the public hearing, the intended use of the land as
described in the Development Agreement and has considered the health, safety and welfare of the
citizens of the City;
NOW, THEREFORE, BE IT RESOLVED, BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The Agreement, pursuant to Chapter 163 of the Florida Statutes, between Florida
Gaming Centers, Inc. d/b/a Miami Jai -Alai, and the City, relating to the development of the application
of a ±7.6 acre, more or less, parcel of land zoned C-2, "Liberal Commercial," located on the
southwestern intersection of Northwest 36th Street and 37th Avenue at 3500 Northwest 37th Avenue,

Miami, Florida, for the purpose of the development/redevelopment of a parimutuel facility, with
associated gaming, and other permitted commercial uses, is approved.
Section 3. The City Manager is authorized{1} to execute the Agreement, in substantially the
attached form, for said purpose.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
